<br />AN ORDINANCE EST
<br />C�ABLISHING RESPONSIBLE BIDDER
<br />REQUIREMENTS ON PUBLIC WORKS PROJECTS
<br />WHEREAS, Indiana Code § 36 -1 -3 -1 et seq. permits the City of South Bend in the State of
<br />Indiana to exercise any power or perform any function necessary to the public interest in the
<br />context of its local affairs, which is not prohibited by the Constitution of the United States or of
<br />the State of Indiana, or denied or preempted by any other law, or is not expressly granted by any
<br />other law to another governmental entity;
<br />WHEREAS, the City of South Bend, Indiana expends substantial funds for the construction of
<br />public work, a portion of that money being derived from taxes paid by residents;
<br />WHEREAS, the City of South Bend, Indiana seeks to preserve administrative resources by
<br />ensuring that only qualified contractors and subcontractors are awarded contracts on public work
<br />construction projects;
<br />WHEREAS, the City of South Bend. Indiana, based apon its experience, has determined that
<br />quality workmanship, efficient operation, safety, and timely completion of projects are not
<br />necessarily insured by awarding a c - N&ruction contract solely on the basis of the low bid;
<br />WHEREAS, the City of South Beta . Indiana seeks w enhance its ability to identify the lowest
<br />"responsible and responsive bidder" ,.n all public work construction projects by instituting more
<br />comprehensive submission requirements which are in compliance with Indiana State Law; and
<br />WHEREAS, "An Ordinance Establishing Responsible and Responsive Bidder Requirements on
<br />Public Work Projects" will assure efficient use of taxpayer dollars, will promote public safety,
<br />and is in the public interest.
<br />NOW, THEREFORE, BE IT ORDAINED by the City Council of South Bend, Indiana
<br />(hereinafter "City"), that:
<br />Section 1. Public works
<br />For purposes of this chapter, tl team "public work" has the meaning set forth in IC 36 -1-
<br />12-2. "Public work" shall also in_l de the following: any constructing, altering, reconstructing,
<br />repairing, rehabilitating, refinishing refurbishing, remodeling, remediating, renovating, custom
<br />fabricating, maintenance, landsca.r;ng, improving, moving, wrecking, painting, decorating,
<br />demolishing, and adding to or sul: a,,� "ng from any public building, structure, airport facility,
<br />highway, roadway, street, alley, bridge, sewer, drain, ditch, sewage disposal plant, water work,
<br />parking facility, railroad, excava,.ion, or other project, development, real property, or
<br />improvement, or to do any part thereo, whether oi, not the performance of the work herein
<br />described involves the addition to, or fabrication into, any structure, project or development, real
<br />property or improvement herein described of any material or article of merchandise, which is
