Y �> ,� � <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTII BEND, <br /> INDIANA, AMENDING THE LEGAL DESCRIPTION AND MAP WITHIN <br /> ORDINANCE NO. 10165-12 <br /> TO EXPAND THE BOUNDARIES OF THE EXISTING RIVERFRONT <br /> DEVELOPMENT PROJECT AREA UNDER IND. CODE 7.1-3-20-16 <br /> STATEMENT OF PURPOSE AND INTENT <br /> On June 25, 2012 the South Bend Common Council passed Ordinance No. 10165-12 <br /> which identified the boundaries of a Riverfront Development Project for purposes of allowing <br /> special alcoholic beverage permits within this Riverfront Project area, under Ind. Code § 7.1-3- <br /> 20-16 (The Act). This ordinance became effective on June 26, 2012 when it was signed by <br /> Mayor Pete Buttigieg. It was subsequently amended by Ordinance No. 10178-12 to correct an <br /> omission in the legal description of the original ordinance. <br /> Availability of this special riverfront development alcoholic beverage permit to those <br /> downtown South Bend businesses which focus on a dining and cultural experience has been a <br /> boost to the downtown South Bend area. Since passage of the original ordinance, six businesses <br /> have met the stringent qualifications for this permit (qualifications developed through the <br /> Community Investment Dept. working with DTSB (Downtown South Bend)). proving that this <br /> is an effective economic development tool for business attraction and retention in the downtown <br /> South Bend area. <br /> Because of this programs success, the Community Investment Department with <br /> recommendation from members of the Common Council, believes that an extension of the <br /> Riverfront area boundaries is in the best interest of the City and its citizens. An increased area is <br /> expected to attract development of more dining and cultural opportunities to the downtown and <br /> Last Bank area of South Bend. The proposed expansion area provides development opportunities <br /> both downtown and across the St. Joseph River from the burgeoning Farmer's Market District. <br /> The existing Riverfront Development area will be expanded westward within the downtown and <br /> southward along the St. Joseph River between Sample Street and Lincohiway West. The newly <br /> described area satisfies the criteria of 1C 7.1-3-20-16.1 to qualify as a Riverfront Development <br /> Project Area. <br /> NOW, TFIF-REFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> Cl I"Y OF SOUTH BEND. INDIANA as follows: <br /> SECTION I. The Map of the Municipal Riverfront Development Project Area, set forth <br /> in Fxhibit "A" to Ordinance No 10165-12 as amended by Ordinance No. 10178-12, is further <br /> amended as set forth in Exhibit A hereto. <br />
