ORDINANCE NO. 5102 -69 <br />AN ORDINANCE SUPPLEMENTING CHAPTER 25, ARTICLE III, <br />DIVISION 2, SECTION 25 -60, ORDINANCES NO. 3879, <br />4289 and 4494, OF THE MUNICIPAL CODE OF THE CITY <br />OF SOUTH BEND, INDIANA, PROVIDING CHARGES FOR <br />PARKING METER BAGS, AS AMENDED. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA: <br />SECTION I. <br />That Ordinance No. 3879, enacted July 28, 1952, as amended <br />by Ordinance No. 4289 enacted December 14, 1959 and Ordinance <br />No. 4494 enacted August 27, 1962, and being Section 25 -60 of Arti- <br />cle III, Division 2 of Chapter 25 of the Municipal Code of South <br />Bend, Indiana, be and hereby is, further supplemented by adding <br />at the end thereof a new sub - paragraph (c) reading as follows: <br />(c) When contractors or others desire to occupy curb space <br />where there are one or more parking meters for periods of time <br />in excess of the parking time limits established pursuant to the <br />preceding paragraphs, the following procedures shall be followed: <br />(1) The person, firm or corporation desiring to so <br />occupy such space shall make application for permission to do <br />so to the Traffic Engineering Department. The application shall <br />be on forms provided, shall describe with precision the curb <br />space sought to be occupied, together with the number of parking <br />meters included in the space, the normal parking time limit and <br />charge for meter parking in such space. It shall also specify <br />the date or dates and hours during which it is intended to <br />occupy such space and the reason for doing so. <br />(2) The Traffic Engineering Department shall investigate <br />all such applications. The investigation shall include: loca- <br />tion of the space sought; the need for same by the applicant; <br />number of meter spaces actually required; type or types of <br />vehicles which will be using the space, possible pedestrian <br />conflicts; availability of nearby off - street facilities; pro- <br />posed length of occupancy; types of equipment other than vehicles, <br />if any, which may be using the space; such other matters as may <br />be deemed to be .relevant by the Traffic Engineering Department; <br />(3) If, after investigation, the Traffic Engineering <br />Department is of the opinion that the proposed occupancy of curb <br />space is necessary, will not cause undue inconvenience to the <br />public, that the applicant proposes to employ all necessary and <br />appropriate safeguards, and, that the proposed occupancy is in <br />the public interest, it will then approve the application and <br />issue meter bags marked with the date or dates to be used and <br />stamped with the Engineering Department stamp. <br />(4) The fees for such curb occupancy shall be payable in <br />advance and shall be Two ($2.00) Dollars per meter per day or <br />portion thereof, or ($8.88) Dollars per meter per week. <br />Five $5.00 <br />
