ORDINANCE NO. 5102 -69 AN ORDINANCE SUPPLEMENTING CHAPTER 25, ARTICLE III, DIVISION 2, SECTION 25 -60, ORDINANCES NO. 3879, 4289 and 4494, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PROVIDING CHARGES FOR PARKING METER BAGS, AS AMENDED. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. That Ordinance No. 3879, enacted July 28, 1952, as amended by Ordinance No. 4289 enacted December 14, 1959 and Ordinance No. 4494 enacted August 27, 1962, and being Section 25 -60 of Arti- cle III, Division 2 of Chapter 25 of the Municipal Code of South Bend, Indiana, be and hereby is, further supplemented by adding at the end thereof a new sub - paragraph (c) reading as follows: (c) When contractors or others desire to occupy curb space where there are one or more parking meters for periods of time in excess of the parking time limits established pursuant to the preceding paragraphs, the following procedures shall be followed: (1) The person, firm or corporation desiring to so occupy such space shall make application for permission to do so to the Traffic Engineering Department. The application shall be on forms provided, shall describe with precision the curb space sought to be occupied, together with the number of parking meters included in the space, the normal parking time limit and charge for meter parking in such space. It shall also specify the date or dates and hours during which it is intended to occupy such space and the reason for doing so. (2) The Traffic Engineering Department shall investigate all such applications. The investigation shall include: loca- tion of the space sought; the need for same by the applicant; number of meter spaces actually required; type or types of vehicles which will be using the space, possible pedestrian conflicts; availability of nearby off - street facilities; pro- posed length of occupancy; types of equipment other than vehicles, if any, which may be using the space; such other matters as may be deemed to be .relevant by the Traffic Engineering Department; (3) If, after investigation, the Traffic Engineering Department is of the opinion that the proposed occupancy of curb space is necessary, will not cause undue inconvenience to the public, that the applicant proposes to employ all necessary and appropriate safeguards, and, that the proposed occupancy is in the public interest, it will then approve the application and issue meter bags marked with the date or dates to be used and stamped with the Engineering Department stamp. (4) The fees for such curb occupancy shall be payable in advance and shall be Two ($2.00) Dollars per meter per day or portion thereof, or ($8.88) Dollars per meter per week. Five $5.00
