All inspections shall be at the discretion of the Health Officer and nothing in this Ordinance <br />shall be construed as requiring the Health Officer to conduct any inspection nor shall any <br />inspection imply a duty to conduct any other inspection. Nothing in this Ordinance shall be <br />construed to hold the Health Officer responsible for any damage to persons or property by <br />any failure to make an inspection or reinspection. <br />m. REFERENCED STANDARDS HEREIN. Any standard, bulletin, rule or regulation <br />referenced shall include any revisions or amendments made to such instrument. All sampling <br />and testing shall be accomplished according to standards set by the Health Officer. <br />n. COUNTY HEALTH FUND. All monies collected pursuant to this Ordinance shall be <br />deposited in the County Health Fund. Expenditures from this fund shall be in accordance <br />with all applicable laws. <br />SECTION III. The City of South Bend Water Works, which is the intended Community <br />Public Water System (CPWS) in this Ordinance, shall designate and delineate the Wellhead <br />Protection Area (WHPA) in accordance with criteria established in 327 IAC 8-4-1-5 and asset forth <br />in this Wellhead Protection Ordinance. <br />SECTION IV. Property owners within the corporate limits of the City of South Bend not <br />exempted under this Ordinance, utilities or local units of government with multiple facilities on <br />several properties, shall apply for and obtain a Wellhead Protection Area Permit issued by the St. <br />Joseph county Health Department in accordance with the terms and provision ofthis Ordinance, and <br />shall comply with the requirements applicable to all Wellhead Protection Area Permit holders as <br />described in this Ordinance <br />SECTION V. The ordinance shall be in full force and effect from and after its adoption by <br />the Common Council and approval by the Mayor. <br />~~~ <br />Member, South Bend Common uncil <br />1st.
