annual leave <br />ORDINANCE NO. 5202 -70 <br />AN ORDINANCE AMENDING ORDINANCE NO. 4150, <br />BEING SECTION 2 -18 OF THE MUNICIPAL CODE, <br />RELATING TO ANNUAL LEAVE OF OFFICERS AND <br />EMPLOYEES OF THE CITY, AS AMENDED. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA: <br />SECTION I. That Ordinance No. 4150, being Section <br />2 -18 of the Municipal Code, be amended to read as follows: <br />a) Each and every appointive officer, employee, <br />deputy, assistant and departmental and institutional head <br />shall be entitled to an annual vacation as follows: <br />1. Those having less than one years' service <br />with the City: No days paid vacation. <br />2. Those having more than one and less than <br />ten years' service with the City: Ten work- <br />ing days of paid vacation. <br />3. Those having ten years and less than twenty <br />years' service with the City: Fifteen working <br />days of paid vacation. <br />4. Those having twenty or more years' service <br />with the City: Twenty working days of paid <br />vacation. <br />b) The term "working days" refers to all days <br />during which the officer or employee would normally be <br />at work if not on vacation or sick leave, but shall not <br />include legal holidays (except for officers or employees <br />who otherwise would work on legal holidays) or regular <br />days off. <br />c) The term "paid vacation" means that the off- <br />icer or employee shall continue to receive his regular <br />rate of pay during the time that he is on vacation. <br />d) The term "years' service" shall mean with <br />uninterrupted employment by the city. The years of ser- <br />vice shall be calculated from the date of hire, rather <br />than by fiscal years. <br />e) Vacation time shall not be cumulative and <br />any days of vacation not actually used during the calendar <br />year in which they accrue shall be lost, and no additional <br />compensation shall be paid to employees not using part or <br />all of their vacation entitlement. <br />
