L E AS E A G RE E MEN T <br />THIS LEASE is between the CITY OF SOUTH BEND, INDIANA, a municipal <br />corporation, and the SOUTH BEND DEVELOPMENT COMMISSION, an agency of the City <br />of South Bend, Indiana, hereinafter collectively referred to as "Lessor ", and <br />Ridgedale Nursing Home, hereinafter referred to as "Lessee ". Said Lessor and <br />Lessee hereby agree as follows: <br />rMIX"41"Aai <br />DEFINITIONS AND <br />SECTION 1. DEFINITIONS. In addition to the words and terms elsewhere defined <br />in this Lease, the following words and terms as used in this Lease shall have <br />the following meanings unless the context or use indicates another or different <br />meaning: <br />"Act" shall mean the Indiana Statute cited as I.C. 1971, 15- 6 -4.5, <br />as amended or supplemented from time to time. <br />"Lessor" shall mean the City of South Bend, Indiana, and the South <br />Bend Development Commission, both acting pursuant to said Act. <br />"Lessee" shall mean Ridgedale Nursing Home, an Indiana partnership, <br />and its successors and assigns, including any surviving, resulting, or transferee <br />corporation, partnership, or sole proprietorship. <br />"City" shall mean the City of South Bend, Indiana, a municipal corporation <br />existing under the laws of the State of Indiana. <br />"Indenture of Trust" shall mean the Indenture of Trust among the <br />City, the Commission, the Lessee, and the Trustee. <br />"Trustee" shall mean the St. Joseph Bank and Trust Company, South <br />Bend, Indiana, acting in its fiduciary capacity under said Indenture of Trust. <br />"Commission" shall mean the South Bend Development Commission estab- <br />
