lished pursuant to ordinance of the Common Council of South Bend, Indiana. <br />"Construct" and "construction" includes repair, maintain, renovate, <br />remodel, rebuild, enlarge, or make major structural improvements on or additions <br />to existing buildings, as well as to build new improvements on unimproved land. <br />"Bond" and "Bonds" shall mean the Economic Development Revenue Bonds <br />of the City issued pursuant to Ordinance No. of the South Bend Common <br />Council, and the documents approved thereunder, the Act, and the procedure <br />established by the Act. <br />"Real Property" shall mean the property described in "Exhibit A ", <br />attached hereto and made a part hereof, together with all improvements constructed <br />prior to project financed by the revenue from the sale of the Bonds and existing <br />thereon on the date of this Lease, and all rights, easements, and appurtenances <br />therein and thereto, which real property is owned by the City for the use and <br />benefit of the Commission. <br />"Facility" shall mean the nursing home structure to be constructed <br />on the Real Property by the Commission which Facility is an expansion of and <br />an addition to the Lessee's existing plant which existing plant is a part of <br />said Real Property. <br />"Leased Premises" shall mean the Real Property and the Facility to <br />be constructed on the Real Property together with equipment, furnishings, and <br />fixtures of the Facility, being more particularly described and defined by <br />the plans and specifications approved by the parties. <br />"Lease Term" means the duration of the leasehold estate in the Leased <br />Premises created by this Lease. <br />SECTION 2. CONSTRUCTION. The laws of the State of Indiana shall govern the <br />validity, performance, and enforcement of this Lease.
