ORDINANCE NO. 5709 -74 <br />AN ORDINANCE TO AMEND SECTION 15 -16 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA, AS AMENDED. <br />BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana, that: <br />SECTION 1. Subdivision (2) of Subsection (a), <br />Section 15 -16 of the Municipal Code of the City of South Bend, Indiana, <br />as amended, is hereby further amended to read as follows: <br />"(2) Mileage Rates: Seventy -five Cents ($0.75) <br />for the first one -fifth (1/5) of a mile or <br />fraction thereof; thereafter, Ten Cents ($0.10) <br />for each additional one -fifth (1/5) of a mile <br />or fraction thereof; and," <br />SECTION 2. Subsection (a) of Section 15 -16 of the <br />Municipal Code of the City of South Bend, Indiana, as amended, is <br />hereby further amended by the addition thereto of the following new <br />subdivision (4): <br />"(4) If the passenger(s) requires the taxicab <br />to carry packages or luggage or other articles, <br />then the trip shall be charged at a minimum <br />rate of fare of One Dollar and Twenty -five <br />Cents ($1.25) when any of the articles are <br />handled by the driver." <br />SECTION 3. Provided, that a taxicab may be hired at <br />the rate of Six Dollars ($6.00) per hour for driving within the City <br />when so hired before the trip is begun; provided further, that charges <br />for waiting time shall be computed on the fraction thereof of the <br />hourly rate. Waiting time shall include the time when the taxicab <br />is not in motion, beginning at its arrival at the place to which it <br />has been called or the time consumed while standing at the direction <br />of the passenger, but no charge shall be made for time lost because <br />of the inefficiency of the taxicab or its driver or time consumed by <br />premature response to a call. <br />SECTION 4. This Ordinance shall be in full force and <br />effect on September 1, 1974. <br />Passed August 12, 1974, as amended. <br />
