ORDINANCE NO..5-Ct lY - - ?6 <br />AN ORDINANCE APPROPRIATING $36, 000.00 FROM <br />THE LOCAL ROADS AND STREETS FUNDS AND <br />$ 4, 000.00 FROM THE CUMULATIVE CAPITAL <br />IMPROVEMENT FUNDS TO PROJECT R & S 70 -1975 <br />MIAMI ROAD FROM KERN ROAD TO JACKSON ROAD. <br />WHEREAS, there was enacted daring the 1969 Session of <br />the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, <br />making available to cities, towns and counties for engineering, construc- <br />tion or reconstruction of roads, streets and bridges under local juris- <br />diction, certain additional funds to be derived from the 7th and 8th cents <br />of Indiana motor fuel tax and fuel use tax and from increases in fees levied <br />under the Motor Vehicle Act; and <br />WHEREAS, no appropriation of such funds was included in <br />the regular 1976 budget for the Civil City of South Bend, Indiana; and <br />WHEREAS, an emergency exists requiring the appropriation <br />and expenditure of certain of said funds already received or to be received <br />before the end of the year 1976 and; <br />WHEREAS, funds have been appropriated for the City's <br />matching funds. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council <br />of the City of South Bend, Indiana: <br />SECTION I. The following sums of money are hereby appropriated <br />and set apart out of the Local Roads and Streets Fund, and the Cumulative <br />Capital Improvement Fund for engineering costs on the following project. <br />R & S 70 -1975 Miami Rd. from Kern Rd. to Jackson Road <br />Local Rds. and Street Fund <br />$ 36,000.00 <br />Cumulative Capital Improvement Fund $ 4, 000.00 <br />Total Appropriation <br />$ 40,000.00 <br />SECTION II.
