ORDINANCE NO. 5993 -76 AN ORDINANCE TO APPROPRIATE $ 8,100.00 FROM THE LOCAL ROAD AND STREET FUND AND $ 900.00 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUNDS TO PROJECT RFC S 72, CONSTRUCTION OF DON40YER AVENUE FROM MAIN STREET TO MICHIGAN STREET WHEREAS, there was enacted during the 1969 Session of the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, making available to cities, towns and counties for engineering, construction or reconstruction of roads, streets and bridges under local jurisdiction, certain additional funds to be derived from the 7th and 8th cents of Indiana, motor fuel tax and fuel tax and from increases in fees levied under the Motor Vehicle Act; and WHEREAS, no appropriation of such funds was included in the regular 1976 budget for the Civil City of South Bend, Indiana; and WHEREAS, an emergency exists requiring the appropriation and expenditure of certain of said funds already received or to be received before the end of the year 1976; and WHEREAS, funds have been appropriated for the City's matching funds. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. The following sums of money are hereby appropriated and ordered set apart out of the Local Roads and Street Fund, and the Cumulative Capital Improvement Fund for additional Right -of -way $ Construction R $ S 72 Donmoyer Avenue from Main St. to Michigan Street Local Roads $ Streets Cumulative Capital Improvement Fund Right -of -Way and Construction Appropriation $ 8,100.00 081 11 9,000.00 SECTION II. This Ordinance shall be in full force and effect from and after its passage and approval as required by law.
