Therefore, Mr. Relos made a <br />motion recommending denial of the request for the vacation based on the review by Area Plan <br />that the requested location may hinder the use of a public tight -of -way, criteria set forth in I.C. <br />36 -7 -3- 13(4). Ms. Roos seconded the motion which carried. <br />UNFAVORABLE RFCOMMENDATION - REQUEST TO VACATE THE NORTH/SOUTH <br />ALLEY FROM JFFFERSON BOULEVARD TO NAPIER S'FRF,ET WEST OF CHESTiNUT <br />STREET: 2) THE EAST'WEST ALLEY WEST FROM _CHESTNUT STREET TO THE <br />SECOND NORTH /SOUTH ALLEY BETWEEN JEFFERSON BOULEVARD AND NAPIER <br />STREET: 3l THE SECOND NORTIL'SOUFH ALLEY SOUTH FROM 7EFFERSON <br />BOULEVARD TO TIIE FIRST FAST /WEST ALf.EY WEST OF CIESTNUT STREET <br />Mr. Gilot indicated that Scorpio Properties, 855 Taft Street, Gary, Indiana 46404, has submitted <br />a request to vacate the above referenced alleys for the purpose of redevelopment of property for <br />residential and commercial uses. Mr. Gilm advised the Board is in receipt of favorable <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Police <br />Department, Fire Department, Solid Waste, Community Investment, slid Engineering. Area Plan <br />stated the vacation would not hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous. The vacation would not make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient <br />The vacation would not hinder the public's access to a church, school or other public building or <br />place. The vacation would not hinder the use of a public right -of' -way by the neighborhood in <br />which it is located or to which it is contiguous. Community Investment stated County property <br />records indicate the petitioner does not own 206, 208 or 210 Cherry Street. These properties <br />would be landlocked if Cherry and the alleys were vacated. The Petitioner has had discussions <br />with those owners about acquisition, but does not have control or a formal option on them. If <br />Scorpio gets ownerslup of these properties, approval of the street and alley vacations would be <br />recommended. Nearly all adjoining parcels are vacant and the alleys are overgrown and appear <br />little used. Ms. Roos stated the request cannot be made if the petitioner does not own the <br />properties. Therefore, she made a motion recommending denial of the request for vacation. Mr. <br />Meeham seconded the motion which carried. <br />UNFAVORABLE. RECOMMENDATION - REQUEST TO VACATE THE NORTH /SOUTH <br />ALLEY GONG NORTH_ FROM THOMAS STREET TO THE FIRST EAST' /WEST ALLEY <br />BETWF,EN WALNUT STREET AND MAPLE STREET <br />Mr. Gilot indicated that Marlene Stevens, 1217 West Thomas Street, South Bend, Indiana, <br />46601, has submitted a request to vacate the above referenced alley for security purposes. Mr. <br />Giber advised the Board is in receipt of favorable recommendations concerning this Vacation <br />Petition from the Area Plan Commission, Police Department, Solid Waste, Community <br />Investment, and Engineering. Mr. Gilot advised the Board is in receipt of unfavorable <br />recommendations concerning this Vacation Petition from the Fire Department. Area Plan stated <br />the vacation would not hinder the growth or orderly development of the unit or neighborhood in <br />which it is located or to which it's contiguous. The vacation would not make access to the lands <br />of the aggrieved person by means of public way difficult or inconvenient. The vacation would <br />not hinder the public's access to a church, school or other public building or place. The vacation <br />would hinder the use of a public right -of -way by the neighborhood in which it is located or to <br />which it is contiguous; the configuration of the remaining north half alley and the east /west alley <br />may hinder the turning radius especially of larger vehicles like garbage trucks. Engineering <br />stated the applicant must maintain utility easements. The Fire Department stated there are garage <br />structures at the crossing of the alleys and the nearest hydrant is on Thomas Street. Therefore. <br />Ms. Roos made a motion recommending denial of the request for vacation based on the review <br />by Area Plan that the requested location may hinder the use of a public right -of -way, criteria set <br />forth in I.C. 36 -7 -3- 13(4).
