a separate offense for each and every day such <br />violation may exist. <br />Sec. 7 -122. Expiration of Licenses and Permits. <br />All licenses or permits issued pursuant to the provisions <br />of this ordinance shall expire on the last day of the <br />calendar year. All practicing massage technicians or <br />operators of massage establishments on the effective date <br />of this ordinance shall immediately be subject to its <br />provisions. <br />Sec. 7 -123. Exemptions. <br />This Article of the South Bend Municipal Code shall have <br />no application and no effect to the following: <br />(a) Hospitals, nursing homes, sanitariums or other <br />health care facilities licensed under the State <br />of Indiana, and physicians, surgeons, chiropractors, <br />osteopaths or physical therapists licensed or <br />registered to practice their respective profes- <br />sions under the laws of the State of Indiana, or <br />nurses registered under the laws of the State of <br />Indiana acting under their direct and control. <br />(b) Barber shops and beauty parlors, barbers and <br />beauticians licensed under the laws of the State <br />of Indiana provided that such massage as is practiced <br />is limited to the head and scalp. <br />(c) Accredited high schools and colleges and coaches <br />and trainers therein while acting within the scope <br />of their employment. <br />SECTION II. Severability. <br />If any provision, section or part of any section of this <br />ordinance is declared to be invalid or unconstitutional, <br />such declaration shall not be construed to affect any of <br />the other provisions, sections or parts of sections herein, <br />and the remainder of the ordinance shall not thereby <br />be invalidated. <br />SECTION III. <br />This Ordinance shall be in full force and effect from <br />and after its passage by the Common Council, approved by <br />the Mayor and legal publication. <br />Jg READING i 3 <br />PUBLIC HEARING <br />2nd READING <br />NOT APPROVED <br />REFERRED <br />PASSED i 3 - 7 <br />\ a <br />-10- <br />FILED IN CLERK'S OFFICE <br />Irene Gammon <br />CITY CLERK.
