ORDINANCE NO. 61 ?q -17 <br />AN ORDINANCE REPEALING ORDINANCE NO. 5339 -71 <br />PASSED SEPTEMBER 27,1971 WHICH ANNEXED TO THE <br />MUNICIPAL CITY OF SOUTH BEND, INDIANA CERTAIN <br />TERRITORY DESCRIBED AS LYING GENERALLY WEST OF <br />HICKORY ROAD, SOUTH OF THE TOLL ROAD, EAST OF <br />IVY ROAD AND NORTH OF THE PRESENT CITY LIMITS, <br />AS AMENDED, AND COMMONLY KNOWN AS MAPLE LANE. <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend by Ordinance No. 5339 -71 passed by the <br />Common Council on September 27, 1971 and approved and signed by the <br />Mayor on September 30, 1971 annexed to the Municipal City of South <br />Bend approximately 950 acres of land described as lying generally west <br />of Hickory Road, South of the Toll Road, Ea.st of Ivy Road and North <br />of the present city limits, and commonly known and described as Maple <br />Lane. <br />Remonstrance was filed to said Ordinance within sixty (60) days <br />after the last publication of said Ordinance by a majority of the owners <br />of land in the territory and that said remonstrance is currently pend- <br />ing for a hearing in St. Joseph Superior Court, Cause No. F -786. <br />Since that time, the City of South Bend has determined that it <br />would be in the best interest of the City not to pursue said annexation <br />and remonstrance further, and that said annexation ordinance should now <br />be repealed. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND: <br />SECTION I. That Ordinance No. 5339 -71 passed by the Common <br />Council on September 27, 1971 approved and signed by the Mayor on <br />September 30, 1971 is hereby repealed. <br />SECTION II.
