Amending Chapter 2 Pertaining to the Rules and Regulations of the Board of Public Works

ORDINANCE NO. (-o °-f77 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 16 AND ARTICLE 17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PERTAINING TO THE RULES AND REGULATIONS OF THE BOARD OF PUBLIC WORKS AND THE ADDITION OF AUTHORIZING THE TAKING OF SEALED PROPOSALS FOR INSURANCE COVERAGE OF THE CITY STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend passed Or- dinance No. 5957 -76 as amended on March 8, 1976. That ordinance established the mechanism by which the Board of Public Works would receive sealed proposals for the City's insurance coverage. However, a typographical error appeared in that ordinance in the chapter and article reference. Therefore this ordinance is introduced to make that correction and to clarify other portions of that ordinance. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Section 16 -2A entitled Board of Public Works, rules and regulations and Section 16 -2B entitled Board of Public Works; purchase of all city insurance by competitive bids of the Municipal Code of the City of South Bend shall be deleted in their entireties. SECTION II. Chapter 2, Article 16 of the Municipal Code of theCity of South Bend, Indiana is hereby amended to read in its entirety as follows: SEC. 2 -16. Board of Public Works; rules and regulations.11a (a) The Board of Public Works shall promulgate such rules and regulations as may be necessary to carry into effect- the operation and intent of this Chapter. (b) The Board shall promulgate such rules and regulations as may be necessary to carry into effect the operation and intent of the powers and duties mandated by State law. SECTION III. Chapter 2, Article 17 of the Municipal Code of theCity of South Bend, Indiana, is hereby amended to read in its entirety as follows: SEC. 2 -17. Board of Public Works; purchase of all city insurance by sealed proposals.11b (a) The Board of Public Works shall have the authority to purchase such insurance to cover the liability of the city as may be necessary to carry out the provisions and intent of this Chapter. (b) All contracts for insurance coverage shall be subject to sealed proposals. (c) Complete specifications for such insurance shall be approved by a committee whose members shall include the City Attorney, Controller, Deputy Controller, and Chairman of the Common Council's Committee on _ Personnel and Finance. Specifications shall be filed with the Clerk to the Board.
