REGULAR MEETING SEPTEMBER 9, 2013 Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, reported that this Committee met this afternoon and it was the consensus of the Committee to send this bill to the full Council with a favorable recommendation. Mr. Michael Danch, President, Danch, Harner & Associates Inc., 1643 Commerce Drive, South Bend, Indiana, made the presentation for this bill on behalf of his client the University of Notre Dame. Mr. Danch advised that this bill would allow for the correction of a scrivener’s error in Vacation Ordinance No. 8551-94. the error occurred in the legal description within the Ordinance only, the vacation diagram that accompanied the Ordinance correctly depicted the alley that was to be vacated. He noted that the reason for this request is to allow the St. Joseph County Auditor’s Office and Assessor’s Office to show correctly on their records that the alley that was intended to be vacated was officially vacated. It will also allow for future buyers of the properties adjacent to the vacated Alley to be aware that the Alley has been vacated and cannot be used for access purposes. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. There being no one present wishing to speak to the Council either in favor of or in opposition to this bill. Councilmember Dieter made a motion for favorable recommendation to full Council concerning this bill as substituted. Councilmember Schey seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 40-13 PUBLIC HEARING ON A BILL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING SECTION 14-56 OF CHAPTER 14, ARTICLE 9, OF THE SOUTH BEND MUNICIPAL CODE ADDRESSING TEMPORARY RESIDENTIAL ONE-DAY CONDITIONAL USE PARKING PERMIT PROCEDURES AND FEES AND SEASONAL CONDITIONAL USE LAWN PARKING PERMIT Councilmember Dieter made a motion to strike this bill from the agenda. Councilmember Schey seconded the motion which carried by a voice vote of nine (9) ayes. RISE AND REPORT Councilmember Oliver Davis made a motion to rise and report to full Council.
