REGULAR MEETING SEPTEMBER 9, 2013 <br /> <br /> <br /> <br /> <br />Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br />reported that this Committee met this afternoon and it was the consensus of the Committee to <br />send this bill to the full Council with a favorable recommendation. <br /> <br />Mr. Bernard Feeney, Lang Feeney, & Associates, Inc., 715 South Michigan Street, South Bend, <br />Indiana, made the presentation for this bill on behalf of his client Maribeth Roncz. <br /> <br />Mr. Feeney advised that they are requesting the vacation to better facilitate pedestrian cross <br />traffic between the two businesses on either side of the alley. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill. Councilmember Dieter made a motion for favorable recommendation to full Council <br />concerning this bill as substituted. Councilmember Scott seconded the motion which carried by <br />a voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 39-13 PUBLIC HEARING ON A BILL TO VACATE <br /> THE FOLLOWING DESCRIBED PROPERTY: <br /> THE PUBLIC ALLEY EAST OF MAIN STREET <br /> BOUNDED BY WAYNE STREET ON THE <br /> NORTH AND WESTERN AVENUE ON THE <br /> SOUTH <br /> <br />Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br />reported that this Committee met this afternoon and it was the consensus of the Committee to <br />send this bill to the full Council with a favorable recommendation. <br /> <br />Mr. James Masters, Nemeth, Feeney, Masters & Campiti, P.C., 211 W. Washington, Suite 1800, <br />South Bend, Indiana, made the presentation for this bill on behalf of the St. Joseph County <br />Public Library. <br /> <br />Mr. Masters advised that the vacation is ought to eliminate vehicular traffic through the <br />street/alley adjacent to the Library buildings and parking lot. The Library intends to expand its <br />parking area for the Main Library and other Library buildings on the lots owned by the Library <br />to the east of the street/alley. The vacation is requested out of concern for the safety of <br />pedestrians using the parking lots and Library buildings. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill.
