ORDINANCE NO. 6317 -78 AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAPTER 20, ARTICLE 7, SNOW ROUTES OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that quick and efficient snow removal procedures are essential to the health, safety and economic benefit of this community. The Council further acknowledges that residential areas can best be cleared of snow during normal working hours, and that the designated snow routes can be cleared more effectively during the evening and early morn- ing hours. Since the Council is concerned about keeping all of its City streets functioning during the snow season, it hereby introduces an Ordinance which will serve this interest, and the citizens of the City of South Bend. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20, Article 7, Section 20 -101 Definitions, of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read in its entirety as follows: Section. 20 -101. Definitions. (a) As used in this Article: (1) CITY -WIDE SNOW EMERGENCY means a formal declaration by the Snow Removal Coordinator that in his opinion the actual or expected precipita- tion of snow will create hazardous or dangerous street and sidewalk condi- tions. (2) PUSHING SNOW means the moving of an amount of snow that may impede or unnecessarily hamper traffic flow. (3) SNOW means any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice and freezing rain. (4) SNOW REMOVAL CONDITIONS means the accumulation of four (4) or more inches of snow in any one continuous period of time as reported by the U.S. Weather Bureau. (5) SNOW REMOVAL COORDINATOR means the Mayor or in his absence the following succession of people shall qualify: City Controller, City Engineer, or the Manager of the Bureau of Streets. (6) SNOW ROUTES means all streets in the City so designated and marked. (7) VEHICLES means all self - propelled motorized licensed vehicles using City streets and highways, excluding public transportation con- veyances. (8) WEATHER DISASTER means a formal declaration by the Snow Removal Coordinator that occurrence or eminent threat of wide - spread or severe damage, injury or loss of life or property resulting from a snow storm requires emergency action to avert danger, damage or distress.
