REPORT OF ORDINANCE COMMITTEE RE COMMENDED REPORT BY THE ORDINANCE COMMITTEE FOR THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA In regard to the:.proposed ordinance amending the Building Code and establishing new fees for building permits, the Ordinance Committee recommends the following amendments to the proposed ordinance before consideration for adoption. 1. That paragraph 7 of Section 37a be stricken from the proposed ordinance. 2. That paragraph 8 be amended so that said paragraph shall read: "For altera- tions and repairs not otherwise provided for, for roofing repairs, re- roofing, for tanks, towers, platforms, stacks and other miscellaneous buildings and structures not included in the preceding schedule and for which volumes cannot be computed, the fee shall be two dollars ($2.00) for the first one thousand ($1,000) dollars of cost or fraction thereof, one dollar and fifty cents ($1.50) for each one thousand dollars ($1,000) of cost or fraction thereof above one thousand dollars ($1,000) up to and including ten thousand dollars ($10,000), one dollar ($1.00) for each one thousand dollars ($1,000) of cost or fraction thereof above ten thousand ($10,000) dollars up to and including one hundred thousand dollars ($100,000), and fifty cents (0.50) for each one thousand dollars ($1,000) of cost or fraction thereof above one hundred thousand dollars ($100,000). 3.. That paragraph 13 of Section 37a be amended so that for signboards shall be at the rate of one dollar feet (250 sq. ft.) of area or fraction thereof. This committee having made a study of the proposed ordinance as-contained in this report, the ordinance is acceptable and to all concerned. it shall read: "The fee X1.00) for each 250 square feel that with the proposed changes the fees provided therein equitable Members of the Ordinance Committee- /s/ Geo. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred "An Ordinance:Amending Ordinance No. 3702 commonly known as "The Zoning Ordinance of the City of South Bend, Indiana"' Lots 7, 8, and the east 33 feet of lot 6 in Herrick and Gran Addition as per petition of Charles H. Gerhardt, et al., respectfully report that they have examined the matter , and that, in their opinion, the matter should be continued until April 23rd, 1956, at which time public hearing will be had on same. Motion by Councilman Kroll and Seconded by 'Councilman Carr, that the report be accepted and placed on file. Motion carried. ORDINANCE . AN ORDINANCE. AMENDING ORDINANCE NO. 2243 COMMONLY KNOWN AS THE BUILDING CODE OF THE CITY OF SOUTH BEND, INDIANA, AND MORE PARTICULARLY REPEALING SECTION 37:a AND ANY AMENDMENTS THERETO, KNOWN AS THE SECTION ESTABLISHING FEES FOR BUILDING PERMITS, AND ENACTING IN LIEU THEREOF A NEW SECTION 37a ON THE SAME SUBJECT, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on:. April 23rd, 1956. Seconded by Councilman Kroll. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $1602.00 TO SEWER DEPARTMENT J -726 OTHER EQUIPMENT $1602.00, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1956, AND DECLARING AN EXTRA - ORDINARY EMERGENCY. The Ordinance wassgiven first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for public hearing on April 23rd, 1956. Councilman Muszynski seconded the motion. Motion carried. UNFINISHED BUSINESS IRVING J. SMITH, City Attorney, read the following reports: Hon Edward F. Voorde Mayor of South Bend South Bend, Indiana Dear Mayor Voorde: March 23, 1956 A survey of conditions relative to vehicular delay caused by train operations was made on March 7th and March 8, 1956 at the intersection of Sample and Olive Streets in South Bend, Indiana. The survey was conducted for a 29 hour consecutive period between the hours of 11 A.M., and 12 midnight on March 7th and between the hours of 12 midnight and 4 P.M., on March 8th.
