9 <br />REGULAR MEETING <br />REPORT OF CITY PLAN COMMISSION <br />Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />November 9, 1955 <br />NOVEMBER 14TH 1955 <br />In the matter of the attached petition of Josephine Bredzinski of 1232 W. Napier, et al to zone Lot No. 64 of <br />Commissioner's Subdivision of Bank Out Lots numbers 85 and 86, from "C" Commercial to "B" Residential Use District, <br />said lot being at 1222 W. Napier Street, the Commission found as follows: <br />RLH: aed. <br />Attachment <br />"After due consideration the Commission found that in their unofficial <br />opinion the petition was not a legal and valid petition inasmuch as <br />the petitioners did.not represent fifty -one percent or more of the <br />property involved in said petition, as prescribed in Chapter 174, Acts <br />of 1947 and of Ordinance No. 3702. The Commission further found that <br />it was within their jurisdiction to make thid -legal determination. <br />It was therefore moved, seconded, and carried that the petition be <br />referred to the Common Council for a determination as to its legality." <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />Robert L. Huff <br />Director - Secretary <br />Councilman Glass moved that the petition be accepted and placed on file. Councilman Korpal seconded the motion. <br />Motion carried. , <br />Councilman Hahn moved that the Council reject the petition as being illegal. Councilman Niezgodski seconded the <br />motion. Motion carried. <br />ORDINANCE NO. 4067 <br />AN ORDINANCE APPROPRIATING FROM PARKING METER FEES <br />AND FUNDS THE SUM OF $20,000.00 FOR SERVICES PERSONAL. <br />The ordinance was given first reading by title and second reading in full. Councilman Hahn moved for suspension <br />of rules. Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - <br />1 absent (Councilman Bestle). <br />The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - l absent (Councilman <br />Bestle). <br />ORDINANCE <br />AN ORDINANCE TRANSFERRING AND APPROPRIATING CERTAIN <br />FUNDS IN THE GENERAL FUND, STREET AND TRAFFIC FUND, <br />FIREMEN'S PENSION FUND AND CITY PLAN FUND, ALL OF THE <br />BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR , <br />1955 AND DECLARING AN EXTRAORDINARY EMERGENCY. <br />The ordinance was given first reading by title and second reading in full. Councilman Korpal moved that the <br />ordinance be referred to the Committee of the Whole for public hearing on November 28th. Councilman Glass seconded <br />the motion. Motion carried. <br />NEW BUSINESS <br />Councilman °Glass moved that the °Board of Public Works contact the South Shore to repair street and tracks along <br />LaSalle Avenue. Councilman Korpal seconded the motion. Motion carried. <br />There being no further business before the Council, Councilman Hahn moved °to adjourn, which motion was seconded by <br />Councilman Korpal.
