REGULAR MEETING <br />REPORT OF THE COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />DECEMBER 13TH, 1954 <br />Your Committee of the Whole to whom was referred "An Ordinance amending Ordinance No. 3702 commonly known as the <br />Zoning Ordinance of the City of South Bend, Indiana." (Garage - private). <br />Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to the <br />Ordinance Committee for further study. <br />W. A. Motion <br />carried. <br />REPORT OF CITY PLAN COMMISSION <br />Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlmen.:. <br />The attached petition of Christian Gospel Assembly by Earl Broadwell, Trustee, and Pauline Broadwell, owners, to <br />rezone Lots 112, 113, 114 and F of Second Addition to Riverdale in River Park, from A- Residence Use District and <br />A- Height and Area District to B- Residence District and B- Height and Area, was advertised 26 October, '54, and <br />given Public Hearing on 4 November '54. <br />These lots are southwest of the intersection of Logan St. and the Grand Trunk Railroad right -of -way. <br />The adoption of the Ordinance is recommended. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />Robert L. Motion <br />carried. <br />ORDINANCE NO. 4021 <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY <br />KNOWN_'AS THE ZONING ORDINANCE OF THE CITY OF SOUTH <br />BEND. <br />(Southwest of the intersection of Logan St. and <br />the Grand Trunk Railroad right -of- way). <br />The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for <br />suspension of rules. Councilman Korpal seconded the motion. The presiding officer asked if there were any <br />remarks or anyone in the audience who cared to be heard on this ordinance before the Council votes on this ordinance. <br />There being no objections, motion was carried by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman Glass). <br />The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman <br />Glass). <br />REPORT OF CITY PLAN COMMISSION <br />Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The petition of Paul and Mae Tuesley to rezone Lots 1, 2, 3, and 4 of Lincoln Terrace Addition from B -Use and <br />A- Height and Area District to C- Commercial Use and A- Height and Area District, was legally advertised on date <br />of 22 November, '54, a public hearing held thereon by the City Planning Commission under date of 2 December, '54. <br />These lots located on the northwest corner of Kaley St. and Lincolnway West. <br />The adoption of the ordinance relative thereto is not recommended for the following reasons, as transcribed from <br />the 2 December meeting of your City Planning Commission: <br />1. "There now exists a 239.5 foot frontage on Lincoln Way West immediately to the <br />East of subject property, separated only by Kaley Street, a street of 60 foot <br />right -of -way and that this frontage is now zoned commercially and has been <br />Vacant since its rezoning in November 13, 1951. <br />2. That the use of lands in the immediate area is predominantly residential use. <br />3. That the granting of petition would, in effect,be a continatuion of "strip zoning" <br />along Lincoln Way West, which is against the best concepts of zoning for consolidated <br />shopping districts with sufficient off - street parking. <br />( Continued) <br />
