<br />Gentlemen:
<br />The petition of David and Patricia Rydzinski to rezone a parcel of land on the south-cast corner of Olive and
<br />Longley Streets from A- residential and C- height and area district was given public hearing by your Planning
<br />Commission on October 21, 1954.
<br />The petition is not recommended for the following reasons, as quoted from the last Minutes "This would constitute
<br />spot zoning, as the entire area is predominantly single family residential use, and that there is ample
<br />commercially zoned areas within a block of the subject property."

<br />REPORT OF CITY PLAN COMMISSION
<br />Common Council
<br />City of South Bend
<br />South Bend, Indiana
<br />Gentlemen:
<br />Your City Planning Commission has been unable to date to comply with Common Council resolution requesting the
<br />Planning Commission to make the necessary study and submit the recommendations relative to the adoption of
<br />legislation for off- street parking requirements. The Commission and the Commission staff are and have been
<br />working towards this recommendation and will report it out at the earliest possible date.
<br />In the meantime, Ordinance 3702, the Zoning Ordinance of South Bend, does not give the Board of Appeals explicit
<br />or implicit authority to grant off- street'parking lots as a transitional use between residential and commercial
<br />or industrial use in an area zoned residentially. Parking lots developed under certain restrictions and conditions
<br />imposed by the Board of Appeals offer a very good transitional use between the different areas..
<br />The proposed Ordinance presented herewith will give the Board of Appeals the necessary authority to grant such uses.
<br />The Ordinance was legally advertised under date of September 28, 1954 and a public hearing was h6ld by your Planning
<br />Commission under date -,of October 21, 1954. The Ordinance is favorably recommended.

<br />suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 7 ayes (Council-
<br />men Erler, Korpal, Bestle, Niezgodski, Glass, Hahn and Muszynski) - 0 nays - 1 absent (Councilman Pinter).
