REGULA..R MEETING <br />AUGUST 23RD, 1954 <br />The Common Council of the City of South Bend, Indiana, met in the Council Chambers on the 23rd day of August, <br />1954, at the hour of 8:00 P.M. in regular session in accordinance with the rules of the Council. <br />The meeting was called to order by the President, Walter C. Erler Sr., who presided. <br />The members of the Council were shown to be present or absent as follows: <br />Present: Councilman Walter C. Erler Sr,, Stan-163r Korpal, <br />Michael Pinter, Cloyd Bestle, Clem Niezgodski, <br />Walter Glass, William A. Hahn and Chester Muszynski. <br />Absent: None. <br />REPORT OF COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have <br />inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend <br />that the same be approved. <br />Meeting -qf August 9, 1954. <br />WALTER C. ERLER SR. ) <br />STANLEY C. KOPPAL ) Committee <br />W. A. HAHN ) <br />Councilman Niezgodski moved that the report be accepted and placed on file. Councilman Glass seconded the <br />motion. Motion carried. <br />PETITION <br />Petition of Bernard E. Vodnoy and Daniel Robert Lindborg to rezone a tract of land 90 feet in length east and <br />west taken off of and from the entire east end of the south one -half of Lot 16 as shown on the recorded plat <br />of J. Co Bartlett's first Addition to the City of South Bend, from "C" 1 Commercial and "C" Height and Area <br />District to "F" Height and Area District. <br />Councilman Glass moved that the petition be referred to the City Plan Commission. Councilman. Hahn seconded <br />the motion* Motion carried. <br />PETITION <br />Petition of David T. Rydzinski and Patricia Ann Rydzinski to r econe the following described real estate: <br />Beginning on the East line of Olive Street, in the City of South Bend at a point <br />40 feet North of the intersection of the East line of said Olive Street, as now <br />established (which street is 50 feet wide), and the South line of Lot Numbered <br />11 as shown on the recorded Plat of Kundtman and Meyers Addition to the City of <br />South Bend; thence running North on the East line of Olive Street, 86.18 feet, <br />T <br />ore or less, to the South line of Longley Avenue in said City; thence East <br />along the South line of Longley Avenue a distance of 135 feet; thence South <br />on a line parallel with the East line of Olive Street, 85.25 feet; thence West <br />to the place of beginnings from "Residential to Commercial." <br />Councilman Korpal moved that the petition be referred to the City Plan Commission. Councilman Niezgodski <br />seconded the motion. Motion carried. <br />REPORT OF CITY PLAN COMMISSION <br />Common Council <br />City of South Bend <br />South Bend, Indiana August 6, 1954 <br />Gentlemen: <br />The attached petition of F. H. Frisbie, et al, to rezone Lots 1, 2 and 3 of Riversale 1st Addition from B <br />Residence District to C Commercial and D height and area districts was given legal notice under date of June <br />21st and public hewing by the Planning Commission under date of July 1, 1954. These lots located southwest <br />corner Mishawaka and 36th Streets. <br />It is recommended that this petition be denied for the following reasons: <br />1. The granting of petition would be an intrusion into a residential distri et. <br />2. It would tend to promote strip zoning along Mishawaka Avenue as opposed to <br />consolidated shopping districts. <br />39 85% of the frontage on Mishawaka Avenue between Ironwood Drive and 34th Street <br />is now zoned for commercial use; therefore, there is no justifiable need for <br />additional Commercial use to serve the immediate community. <br />City Planning Commission <br />(Signed) Robert L. Huff, Secretary <br />Councilman Hahn moved that the report of the Planning Commission be accepted and placed on file. Councilman <br />Niezgodski seconded the motion. Motion carried. <br />
