Motion <br />carried. <br />REPORT OF THE COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: <br />Your Committee of the Whole to whom was referred "An Ordinance concerning dealers in scrap or junk materials, <br />and providing for the licensing and regulation thereof, penalties for the violation, and repealing all ordinances <br />in conflict therewith ". <br />Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to <br />the Ordinance Committee and any councilman interested in this ordinance be invited to attend this meeting and <br />amendments drawn and presented at the next Council meeting on May 10th. <br />W. Councilman Muszynski seconded the motion. <br />Motion carried. <br />REPORT OF CITY PLAN COMMISSION <br />Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />11 <br />Petition of Willy's Overland, Inc. of South Bend and Gasterial Inc. to rezone lots on the northwest corner of <br />Indiana and Michigan Street from C commercial to D light industrial was legally advertised under date of March <br />24, 19540 and given public hearing under date of April 1, 1954. <br />='This change is not recommended for the following reasons, which are transcribed from the Planning Commission <br />minutes: <br />"1. Michigan Street is predominantly a commercial street, is so zoned; and <br />with few exceptions, so used. , <br />2. Granting of petition would in effect set a precedent for future industrial <br />development along this artery. <br />3. There is considerable light and heavy industrially zoned areas immediately <br />to the west of petition area. <br />4. The use of the land in the petition area precludes off- street parking and <br />loading. ". <br />Very truly yours, <br />Robert L. Motion carried. <br />REPORT OF CITY PLAN COMMISSION <br />Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gent lemon: <br />Returned herewith, after further consideration by the City Planning Commission under date of April 23rd in <br />special meeting, is ordinance to amend the district map of the South Bend zoning ordinance from A use and A <br />height and area to E use and E height and area in the area at Lincoln Way West and Bendix Drive, which ordinance <br />was originated by the Planning Commis sion and which o rdinance honors, in effect, the recommendat ion of the <br />Council regarding suaVight industrial district'as opposed to an original petition recommending heavy industrial <br />for a part of said area. This proposed ordinance was given public hearing under date of January 7, 1954. <br />This ordinance is strongly recommended for the following reasons s <br />1. Subject area is served by a railroad spur, a major thoroughfare of sufficient eapaoity to <br />handle additional traffic load that would be generated by industrial use of area, a 48 inch trunk <br />sewer on Lincoln Way West the capacity of which is entirely sufficient to handle increased load <br />that would be occasioned by industrial use on subject property.
