REGULAR MEETING <br />COMMUNICATION <br />Members of the Common Council <br />FEBRUARY <br />1954 <br />I see where the New York Central kept their part of the bargain that was promised use But I am quite sure that <br />without your cooperation we would never see the Deiselts this soon. <br />There were times when we gave up hope of ever seeing Deisels put in for switching out on the west side, but with <br />your whole support we have, and its really hard to believe. <br />I do think that this will make our neighborhood -more liveable and cleaner for our youngsters to grow up in. <br />I want to thank one and all of your gentlemen for the wonderful help you gave us. Also the Chief of Police for <br />the grand support he gave by posting his men out here on duty every week. <br />Respectfully, <br />Mr. & Mrs. Ed. Spyehals ki <br />and the Ladies of the West side. <br />Councilman Korpal made a motion that the communication be accepted. Councilman Muszynski seconded the motion. <br />Motion carried. <br />PETITION <br />TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: <br />The undersigned, owners of Lot Numbered 4 as shown on the recorded Plat of Charles Weidlers 1st Addition to the <br />City of South'.Bend, Indiana (2311 Miami Street) hereby petition your honorable body to amend and supplemo t the <br />present zoxiing ordinance by the adoption of an ordinance changing the zoning classification of the aforesaid <br />described.property from "A" residential district, "A" height and area district to "C" commercial district and <br />"D" height and area district. <br />There accompanies this- petitio4 proposed ordinance amending and supplementing ordinance Number 3702 in accordance <br />with the above request. <br />Dated this 4th day of February, 1954. <br />EDVKRD DEAVEL AND LYDIA DEAVEL <br />By: Joseph A. Motion carried. <br />PETITION <br />TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. <br />The undersigned petitioner would represent and show to the Honorable Common Council of the City of South Bend, <br />Indiana, that he is the legal owner of the following described real estate situate in the City of South Bend, <br />;` Iounty of St. Voseph, State of Indiana, to wit: <br />All of that real estate which consists of one (1) square block in said City and County bounded on the East by <br />Miami Street, on the North by Dubail Avenue, on the West by Dale Avenue and on the South by Dayton Street, all <br />of which said square block is more particularly and legally described as follows: <br />Lots Numbered Fifty -seven (57) through Seventy -Six (76) <br />inclusive in the Recorded Plat of Oak Park Second Addition, <br />an Addition to the City of South Bend, Indiana. <br />Your petitioner would further represent and show to this Honorable Body that at the time of the recording of the <br />plat herein above set forth that there were various and divers alleys running East and West and North and South <br />through said square block and that all 'of said alleys have heretofore been vacated by legal process and the fee <br />title thereto has by operation of law reverted to the undersigned petitioner. <br />Your petitioner would further represent and show that Lots Number Fifty Seven (57) through sixty four (64) <br />inclusive in Oak Park Second Addition heretofore described in this petition, are now zoned "C" Commercial as to <br />usage and "E" Height and Area as to Height and Area District. <br />Your petitioner would further represent and show that all the rest and remainder of said real estate heretofore <br />described with the - !exception of the illeys referred to, is zoned 'tA" Residential as to usage and "A" Height and <br />Are as to ffei ght and Area District. <br />Your petitioner would call to the attention of this Honorable Body that the vacated alleys in saidsluare block <br />heretofore described, have never been officially zoned in any marmer as they were vacated subsequent to the <br />passage of the zoning ordinance affecting the described real estate. <br />Your petitioner desires to call to the,attention of the Common Council that all of said real estate herein <br />described and owned by the undersigned petitioner, is occupied by the St. Matthews Roman Catholic' and <br />School and buildings incident to the operation of said Church and School. <br />Your petitioner now prays the Common Council of the City of South Bend that Lots Numbered Fifty -Seven (57) through <br />Sixty Four (64) inclusive in said plat be changed from their present zoning of "C" Commercial to the zoning <br />classification of "B" Residential District and that the "E" Height and Area District now provided for said lots <br />remain unchanged, and your petitioner would further pray the Common Council of the City of South Bend that all of <br />the rest and remainder of the real estate herein described including the vacated alleys hereinbefore referred to, <br />be changed from the present zoning of "A"-Residential District and A" Height and Area District to "B" Residence <br />and "E" Height and Area District for the following reasons: <br />1. That it is the purpose of the undersigned, to cause a rectory to be constructed for the use of the <br />priests on a portion of the property now zoned Commercial and that under said Commercial zoning, a building being <br />erected for dwelling purposes, is not permitted. <br />2. Your petitioner desires to have all of said tract of real estate in the same zoning and Height and use <br />classification. <br />(Continued) <br />
