JOSEPH COUNTY j <br />IN THE MATTER OF THE PETITION OF <br />LOUIS MAJOR FOR REZONING OF REAL ESTATE. <br />FEBRUARY <br />BEFORE THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND <br />TO: The Common-Council of the City of South Bend, Indiana: <br />PETITION FOR REZONING REAL ESTATE <br />The undersigned, Louis Major, respectfully petitions and shows this Honorable body the following: <br />1. That he owns the following described real estate situate in St. Joseph County, State of Indiana, which is <br />now zoned and classified under the zoning ordinance of the said City of South Bend, being known as Ordinance No. <br />3702, as amended June 13, 1949, as C -1 Commercial district and D Height and Area District, to wit: <br />A parcel of land described as beginning 184.5 feet South of the North <br />one quarter corner of Section 8, Township 37 North, Range 3 East, being a <br />point on the South line of U. S. Highway No. 20, thence South a distance <br />of 165 feet, thence East a distance 192 feet, thence North a distance of <br />165 feet more or less to a point on the South line of said highway, thence <br />West along the South line of said highway to the place of beginning. <br />2. That he also. owns the following described real estate in said County, adjoining the above described real <br />estate on the south and east, which is now zoned and classified under said ordinance as A Residential District <br />and A Height `and Area District, to -wit: <br />A parcel of land described as beginning 349.5 feet South of the North <br />one quarter corner of Section 8, Township 37 North, Range 3 East, thence <br />South a distance of 106 feet, thence east a distance of 232 feet, thence <br />North a distance of 263.85 feet more or less to a point on the South line <br />of said U. S. Highway No. 20, thence West along the South line of said <br />highway a. distance of 40 feet, thence South a distance of 165 feet, thence <br />West a distance of 192 feet to the place of beginning. <br />3. Attached hereto and made a part hereof is a plat of all the real estate above described, indicating the <br />portion thereof now zoned as C -1 Commercial by the designation "Area C -1 ", and the portion thereof now zoned as <br />A Residential by the designation `Area A ". ') <br />4. That your petitioner desires to have the real estate described in paragraph 2 hereinabove (Area A) rezoned and <br />reclassified by amendment of said zoning ordinance from the above classification to C -1 Commercial District and <br />D Height and Area District. <br />5. That your petitioner intends to make the following use of the real estate first above described if this <br />petition is granted" and said rezoning permitted& <br />Your petitioner prop '6ses to erect a small retail shopping center on the above real estate which is now zoned <br />C -1 Commercial (Area C -1) and to construct an off street parking lot and driveway on the portion of the above <br />real estate for which this rezoning is requested (Area A). Said shopping center will consist of a grocery store, <br />A hardware store, a bakery and a drug store. Your petitioner then plans, after the construction of said shopping <br />center and said off street parking lot, to lease said individual retail stores to individual lessees for use by <br />them as integral parts of said shopping center. <br />6. That the nature and location of the residential area surrounding said real estate indicates that the majority <br />of the customers of sail proposed shopping center will utilize automobile transportation in their patronage thereof <br />and will be in need of adequate parking facilities; that the use of the real estate designated Area A as an off <br />street parking lot for the use of customers of said shopping center will - avoid excessive parking on U. S. Highway <br />No. 20, on which highway said real estate fronts, and will thus avoid a serious traffic hazard in the proximity <br />of said shopping center; your petitioner believesthat because of the modern trend in automobile shopping the <br />commerical use of Area A is consistent with ' -and necessary to the commercial use of Area C -1 as a shopping center <br />and will cause much latter commercial use t be more beneficial to the surrounding residential community and this <br />city than it would be without such,off street parking facilities for said customers. <br />7VEREFORE your petition respectfully prays that the zoning ordinance of said City of South Bend may be amended <br />to allow the rezoning hereinabove proposed. <br />(Signed) LOUIS MAJOR <br />Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Korpal <br />seconded the motion. Motion carried. <br />PETITION <br />To the Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gent lemen: <br />Petition for change of zoning of Lot No. 36 in Gorsuch Addition, located at 822 So. Kosciuszko St., from "B" <br />Residential and "A" Height and Area District to "C" Commercial and "E" Height and Area District. <br />(19 Signatures) <br />Councilman Korpal made a motion that the petition be referred to the Board of Zoning Appeals. Councilman Pinter <br />seconded the motion. Motion carried. <br />
