om <br />AMENDNM T <br />1 14th. 1952 <br />BE IT RESOLVED BY THE COMMON COUNCIL OF THE CIVIL CITY OF SOUTH <br />BEND, INDIANA, THAT THE RESOLUTION APPROVING A LEASE BY ITS BOARD <br />OF PARK COMMISSIONERS TO THE UNITED STATES GOVERNMENT FOR ARMORY <br />PURPOSES BE AMENDED AS FOLLOWS: . <br />A strip of land 50 feet in width along the north side <br />of North Side Boulevard shall be excluded from said <br />lease in order that a beautiful vista may be maintained <br />by the Park Department. <br />APRIL 21ST. 19 <br />Councilman Niezgodski made a motion that the above amendment be adopted. Councilman Muszynski seconded the <br />motion. Motion carried. Roll call vote of 7 ayes - 1 nay. <br />Councilman Niezgodski made a motion that the above .Resolution be adopted as amended. Roll call vote of 7 ayes - 1 nay. <br />RESOLUTION <br />BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the contract heretfore entered . <br />into between the Board of Public Works and Safety of said city and the Rieth -Riley Construction Company for <br />the pairing of Wayne Street from the east line of Taylor Street to the east line of St. Joseph Street for the <br />contract price of twenty -seven thousand eight hundred fifty -three and 70100 Dollars ($27,853.70) is confirmed <br />and approved. <br />WALTER G. Motion <br />carried._ Roll call vote of 8 ayes - 0 nays. <br />PETITION <br />TO THE COMMON COUNCIL <br />CITY OF SOUTH BEND, INDIANA <br />Comes now Jack McCormack, petitioner herein and respectfully represents and shows unto this Honorable Body; <br />That he is the owner in fee simple of certain real estate situate in the City of South Bend, in said county and <br />state, a"aid real estate being more particularly described as follows, to -wit: <br />Lots Numbered 3 and 4 in Fernwood Addition to the <br />City of South Bend. <br />That your petitioner is desirous of adding two (2) apartments to a structure now thereon located; and that <br />said real estate is now zoned "A'} Residential; that he is desirous of having said real estate rezoned from <br />"A" residential to "B" residential, which latter classification would permit the use of said land for the <br />purposes herein "stated. <br />WHEREFORE, your petitioner prays this Honorable Body to rezone saidland from "A" residential to "B" residential. <br />(Signed) JACK MCCORMACK <br />Councilman Hahn made a motion that the petition be referred to the City Plan Commission. REINKE & SONS <br />TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: <br />The undersigned, Carl J. Reinke and Harold G. Reinke, doing business as Carl J. Reinke & Sons, hereby respectfully <br />petition the honorable Common Council of the City of South Bend and say: <br />1. That said petitioners are the owners of the following described real estate: <br />Part of Bank Out Lot Numbered Ninety -nine (99) of the Second Plat of Out Lots of <br />the Town, now City of South Bend, platted by the State Bank of Indiana, described as: <br />Beginning at a point Forty (40) feet West of the intersection of the South Line <br />of Ford Street with the East line of said Bank Out Lot Numbered Ninety -nine (99). <br />running thence West One Hundred Twelve (112) feet; thence South One Hundred Fifty - <br />two and Seventy -five Hundredths (152.75) feet; thence East One Hundred Twelve (112) <br />feet; thence North One Hundred Fifty -two and Seventy -five Hundredths (152.75) feet <br />to the place of beginning, in St. Joseph County, Indiana, excepting therefrom the <br />part taken for railroad purposes in Condemnation Proceedings filed in Cause No. <br />27884, St. Joseph Superior Court No. 1. <br />2. That said property is located on Ford Street in the City of South Bend, adjoining the New Jersey Railroad <br />and is presently zoned "D" - Light Industrial district and "E" - Height and Area district. <br />3. Said petitioners further show said honorable Common Council that there is presently located on said premises <br />a three -stall garage used for the purpose of storing materials used by said petitioners in their construction <br />business, and that it is necessary that said property be re= classified as to height and area to that of "F" <br />Height and Area district, being a change from Section 14 of the zoning ordinance of the City of South Bend, being <br />Ordinance 3790 adopted December 11, 1950, to that of Section 15 of said Zoning Ordinance above described. <br />4. The said petitioners request said change of only Height and Area district for the reason that it vDuld work <br />an undue hardship upon them in establishing their warehousing space on said property to be denied the use of the <br />said rear yard as restricted in the present classification of "E" - Height and Area district. Said petitioners <br />further show that said change as herein prayed for will not be.detrimental to the surrounding area nor in any <br />way diminish or detour property values of the surrounding neighbors. <br />(Continued) <br />
