The Redevelopment Authority <br />Meeting Minutes <br />brought against DuPont. DuPont set up a claims process. The landscaper at <br />Blackthorn was using the product and it did kill some trees. We need the <br />Authority's signature on the paperwork to get the dollar amount that has been <br />determined to replace the trees that died and to purchase tree care for the 13 other <br />trees on the property. <br />Ms. Pfotenhauer asked if this has gone through the proper review. Mr. Relos said <br />the head of the Blackthorn Owners' Association has been working on this for <br />three years. He has reviewed it and has said it is fair. Mr. Relos said DuPont <br />would not allow individuals to remove the trees until they agreed to the <br />settlement. <br />Upon a motion by Ms. Pfotenhauer, seconded by Mr. Alvarez, the Authority <br />approved the settlement for the trees that were killed by the weed killer. <br />d. Authority approval of easement and right of way for Lot 8 at Blackthorn <br />Corporate Office Park with Indiana Michigan Power Company <br />Mr. Relos said they have been working with AEP on this for a number of months. <br />There is a pole right outside the property line that is on the State right of way for <br />the bypass. There are lines that run in the property now but AEP wants to put in <br />larger lines, so this easement would allow them to do that as well as put a pole on <br />the bottom SW corner of the property and run underground lines along there. <br />There is a real dip in the SW corner of the lot. AEP doesn't want any grade <br />changes, and we didn't want that language in the easement, so we agreed if <br />someone purchased the lot they would be allowed to build up the corner up to <br />three feet without AEP's approval. <br />Ms. Pfotenhauer asked if the underground lines would hinder the selling of the <br />lot. Mr. Relos stated that the building set back is twenty five feet so nothing could <br />be built on that corner and thus it would not diminish the price of the lot at all. <br />The only thing that could be put on the corner would be some type of landscaping. <br />Upon a motion by Ms. Pfotenhauer, seconded by Mr. Alvarez, the Authority <br />approved the easement and right of way for Lot 8 at Blackthorn Corporate Office <br />Park with Indiana Michigan Power Company. <br />4. NEXT MEETING DATE: September 4, 2013 <br />ADJOURNMENT <br />There being no further business to come before the Redevelopment Authority, the <br />meeting was adjourned at 10:45 a.m. <br />2 <br />
