FEBRUARY 11TH, 1952 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council <br />Chamber, Monday, February 11th, 1952, at 8:00 P.M., with all members present except Councilman Bestle. <br />REPORT OF COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspect <br />the minutes of the previous meeting of the Council and found them correct. Motion <br />carried. <br />COMMUNICATION <br />NEW YORK CENTRAL SYSTEM <br />Mr. E. A. Dougherty: <br />Cleveland, 0., January 23, 1952 <br />File: 455 -XS (4 Files) <br />Reference is made to the following Ordinances relating to highway crossing protection in the City of South Bend, <br />Indiana: <br />Ordinance No. 3832, requiring the New York Central and the New Jersey, Indiana and <br />Illinois Railroad Company to provide and maintain automatic flashlight signals and <br />short arm gates at the crossing of Western Avenue (State Route 2) <br />Ordinance No. 3833, requiring the NewYork Central to provide and maintain automatic <br />flashing light signals at the crossing of Washington Street <br />Ordinance No. 3834, requiring the New York :Central, the NJI &I and Indiana Northern <br />Railroad Co. to provide and maintain automatic flashing -light signals and short -arm <br />gates at the crossing of South Walnut Street <br />Ordinance No. 3835, requiring the New York Central, the Pennsylvania Railroad Co. <br />and, the NJI &IRR Co. to provide and maintain automatic flashing -light signals and <br />short -arm gates at the crossings of Kemble and Prairie Avenues. <br />The Ordinances provide, among other things that the Railroad Companies are given a period of six months to comply <br />and shall notify the-City any time within the period granted that they have complied with the requirements and <br />until such notification is received the Railroad Companies shall maintain such protection at the crossings as now <br />exists, further the period of six months may be extended upon proper showing by the Railroads that difficulties <br />*are being encountered in obtaining the necessary materials. <br />In this connection, I wish to advise that it will be impossible to complete any of the projects within the six <br />months' period stipulated in the Ordinances. <br />The material required for all the projects was ordered during September, 1951. The flashing -light signals and <br />automatic gate assemblies are on hand, however, shipment of wire and cable and other major items of material has <br />not been made and delivery date of same is indefinite. <br />In order to show some progress in this work we are starting the Washington Street project next week and trust <br />that sufficient material will be available to complete this installation. <br />In view of the above, I suggest that you request a six month's extension of time to complete the work covered by <br />the above Ordinances. <br />C. Brooks relating to highway crossing <br />protection in the City of South Bend be accepted and placed on file. Councilman Niezgodski seconded the motion. <br />Motion carried. <br />Councilman Glass made a motion that the railroad companies be given extension of six month's for completion, of <br />flasher light warning signals at its crossings at Western Avenue, Washington Avenue, South Walnut Street and at <br />Kemble and Prairie Avenues, -as required by ordinances" adopted last July 2rd,. Councilman Hahn seconded the <br />motion. Motion carried. <br />REPORT OF CITY PLAN COMMISSION <br />To the Common Council <br />City of South Bend, Indiana <br />Gentlemen: <br />Petition of Forest G. Hay for change of zoning of Lots in Leeppr's Second Addition has been given public hearing <br />by the City Plan Commission and this change is not recommended. These lots are on the south side of Angela <br />Boulevard from North Michigan Street to the railroad. <br />Attached hereto is a remonstrance against this change which was filed with the City Plan Commission. <br />CITY PLAN COMMISSION <br />By: D.
