Councilman Glass made a motion that the report be accepted and placed on file. Councilman Niezgodski seconded <br />the motion. Motion carried. <br />MOTION <br />Councilman Glass made a motion that the regular order of business be suspended so that reports from City Plan <br />Commission pertaining to ordinances be read and immediately following the ordinance be given reading. <br />Councilman Niezgodski seconded the motion. Motion carried unanimously. <br />REPORT OF CITY PLAN COMV ISSION <br />To the Common Council <br />City of South Bend, Indiana <br />Gentlemens <br />January 6, 1950 <br />The City Plan Commission has held.publie hearing on petition of The Light Co. Inc, for change of zoning of <br />an unplatted tract of land 192 x 160 on the south side of McKinley Ave. one half mile East of Ironwood Drive. <br />Petition asks for change of the present zoning as A residence and A height and area districts to C -1 commercial <br />and D height and area districts. <br />The City Plan Ommission recommends this change as petitioned for. <br />In the original zoning of the city a commercial area was made at this location but in the location of <br />McKinley Ave. to avoid low ground no part of the commercial area was left on the south side of the street. <br />This change will provide a small commercial area where it was originally intended to be. <br />M. Moomaw, Seely. carried. <br />`Councilman Tellson made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion <br />Councilman Tellson made a motion for a five minute recess. 'Councilman korpal- seconded the motion. Motion <br />carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND ORDINANCE N0. 3702, AS.AMENDED, WHICH <br />ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY <br />OF SOUTH BEND. (South side of McKinley Ave. ore half mile East <br />of Ironwood Drive) <br />The ordinance was given first reading by title and second reading in full. Councilman Kemper made a motion <br />that the petition be held up for further investigation. Councilman Bestle seconded the motion. Motion carried. <br />REPORT " --tITY. --CITY.PLAN "CONMISSION <br />To the Common Council - <br />City of South Bend, Indiana January 6, 1950 <br />Gentlemen- <br />A hearing has held on January 5, 1950 on petition of Frank A. Slaby, et al for change of zoning of Lots No. <br />1640 165, 166, 168 and 169 in Realty Construction Ca. -2nd Addition, Lots 390, 391, 392, 418, 419 and 420 in <br />2nd Plat of Summit Place, Lots 498 to 507 inclusive, 511 to 519 inclusive, 656 to 661 inclusive in the third <br />Plat of Summit Place. <br />This petition asks to change these lots from C commercial and D height and area districts to B residence and <br />A height and area districts. <br />These lots'frorb on Phillipa, Olive and Ford Streets between Phillipa St. and Meade St. and are now occupied <br />by residence buildings or are vacant. <br />This change is recommended as petitioned for. This change is one of many that should be made to place property <br />In the zoning classification that conforms with the nature of its occupancy. THE CITY OF SOUTH BEND. <br />(Lots front on Phillip&, Olive A Ford Sts. between Phillipa <br />and Meade Sts.) <br />The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion <br />for suspension of rules, Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of <br />8 ayes - 0 nays. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS <br />THE ZONING C:2DINANCE OF THE CITY OF SOUTH BEND, INDIANA. <br />(Lots 85, 86, 87 and 88, Recorded Plat of Lincon Manor <br />Second Addition). <br />The ordinance was given third reading and lost by a roll call vote of 0 ayes - 8 nays'(Erler, Korpal, Tellson, <br />Bestle, Niezgodski, Glass, Kemper, Muszynski).,, <br />.REASONS: <br />Copy of letter asking for withdrawal of petition attached.' <br />
