Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, December 12th, 1949, at 8:12 P.M. with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the - Council and found them correct. They therefore recommend that the same be approved. Meeting of November 28th, 1949. WALTER C. PETITION TO: THE COMMON COUNCIL OF THE, CITY OF SOUTH BEND, INDIANA. Comes now ANN DROUT, your Petitioner herein and respectfully shows to your Board that sheds the fee simple owner of the following described real estate located in the City of South Bend, St, Joseph County, Indiana, viz: Lots # 89, 90, 91, 92, 93, 94, 95 and 96 as shown on the Recorded Plat of Lincoln Manor 2nd Addition to the City of South Bend. That said'real estate has heretofore been classified and zoned as "B" Residential and "A" Height and Area Di st ri ct. _ YOUR PETITIONER respectfully prays that said property be zoned by your Board as Commercial and "E" Height and Area District. YOUR PETITIONER further shows to this Board that said real estate fronts on the North side Westmoor Street and lies between Goodland Avenue and North Bendix Drive. PETITION PETITION FOR AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, WHICH SAID ORDINANCE IS MORE PARTICULARLY KNOWN AS ORDINANCE NO. 37029 FOR THE CHANGE OF ZONING FROM C COMMERCIAL USE DISTRICT AND D HEIGHT AND AREA DISTRICT TO B RESIDENCE USE DISTRICT AND A HEIGHT AND AREA DISTRICT. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: The undersigned, being more than fifty percent (50 *) of the owners of the following described real estate in the City of South Bend, St. Joseph County, Indiana, to -wits Lots Numbered 164, 165, 166, 168 and 169 as shown on the recorded Plat of Realty Construction Company's Second Addition to the City of South Bend; Lots Numbered 390, 391, 392, 418, 419 and 420 as shown on the Recorded Second Plat of Summit Place Addition to the City of South Bend; Lots Numbered 498 to 507 inclusive, 511 to 519 inclusive and 656 to 661 inclusive as shown on the recorded Third Plat of Summit Place Addition to the City of South Bend, Indiana, do hereby respectfully petition that the aforesaid Ordinance No. 3702 be emended in order that the zoning of the above described realty be changed from C Commercial Use District and D Height and Area District to B Residence Use District and A Height and.Area District so that the aforesaid real estate will be adaptable for the uses permitted by and -under said B Residence Use District and A Height and Area 'District and subject to the restrictions pertaining thereto.
