<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the
<br />Council Chamber, September 26th, 19491, at 8:10 P.M. with all members present. President Erler presided at
<br />the meeting.
<br />REPORT OF COMITTEE ON MINUTES
<br />To the Common Council of the City of South Bends
<br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
<br />inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
<br />that the same be approved.
<br />Minutes of August 29th and September 12th, 1949.
<br />Councilman Glass made a motion that the report be accepted.

<br />In view of the fact that a number of residents on Grace Street near the Oliver Corporation Gate have appeared
<br />at meetings of the Committee of the Whole of the South Bend Common Council, it has occurred to me that you, as
<br />chairman, as well as the other members of the Committee would be interested in the contents of the attached copy
<br />of my letter to Mr. Theodore Michalak, who has been spokesman at various times for that neighborhood.
<br />I watched with interest the development of the proposals of the Grace Street property owners and attempted to
<br />elicit the immediate cooperation of the Oliver Corporation officials at the South Bend plant. It seems that
<br />information regarding developments here were channeled through the Chicago office but efforts extended by you,
<br />City Engineer Andrysiak, and the.Six District Councilman were being ignored somewhere along the line. However,
<br />one week ago, Mr. George Lanphere assured me of his personal interest in the matter and that the Corporation
<br />would do everything in its power to cooperate. The results are explained in the accompanying letter.
<br />I now trust that you will no longer be besieged at your oommittee meetings and feel that you, as well as the
<br />other members, should be properly apprised of these developments% I remain

<br />We the undersigned owners in fee of Lots 1 -2 -3 in Mayr's LaPorte Ives Addition to the City of South Bend,
<br />Indiana, petition your Honorable Body to consider the following proposed !Amendment to Ordinance #2331 whereby
<br />Lots 1 -2 -3 in Mayr's LaPorte Ave. Addition to the City of South Bend, Indiana would be changed from "B" use
<br />and "A" height to "D" use and "E" height and area.

<br />Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman
<br />Muszynski seconded the motion. Motion carried.
<br />PETITION
<br />To the Common Council of the City of South Bend for an Ordinance
<br />to Restrict the Use by Motor Vehicles of Grace Street,. East of Arnold
<br />Street, Public Streets in the City of South Bend.
<br />1. The undersigned as Petitioners respectfully submit to the City Council of the City of South Bend, Indiana,
<br />that they, at the addresses opposite their names below given and affixed, are the owners, legal or equitable,
<br />of the real estate indicated at such address.
<br />2. That recently Grace Street, east of Arnold Street, in South Bend, was paved by the City of South Bend.
<br />3. That prior to such paving of said street, the Board of Public Works of South Bend had represented to the-
<br />undersigned that a type of pavement denominated "Class 'C'" would be laid and such property owners consented
<br />to such property assessment for such type of pavement on.the condition that trucks and trucking would be
<br />prohibited on said Grace Street east of Arnold Street.
<br />4. That the Board of Public Works assented to said condition.
<br />5. That thereafter, that is, after the laying of said pavement and immediately on the opening of the said
<br />Grace Street east of Arnold Street to motor vehicle traffic, the Oliver Corporation, altho it has other means
<br />of ingress and egress from its property, resorted to the use of said Grace Street east of Arnold Street for
<br />heavy trucking.
<br />6. That as a result of such.u6s, the pavement recently laid as aforesaid has been cracked in numerous places,
<br />and that persistent further use of said pavement by heavy trucks will completely wreck the newly Said pavement
<br />In front of the property of the undersigned.
<br />7. That the City Engineer of South Bend puts up birrioades and removes them at his pleasure and at the
<br />,convenience of the Oliver Corporation but to the detriment of the property of the undersigned.
