Be it remembered that the Common Council of the City of South Bend net in regular session in the Council Chambers <br />in the City Hall, Monday, May 27, 1940, sat 7:55 P.M., with all members present. See. <br />South Bend City Council <br />City Hall <br />South Bend, Indiana <br />Dear _vUss Nelson: <br />Our organization recently adopted the attached resolution and requested that it be sent to the City Councilmen of <br />South Bend, urging them to do all in their power to see that same is carried out as soon as possible. <br />No doubt if this condition had been taken.care of in the past-at least some of the child fatalitys which have occurr <br />ed in these open. -ravel pits, would have been prevented, and we would not have suffered the loss of children which <br />we have experienced. <br />Please bring this before the City Council at their next meeting and urge their action on same. <br />(SEAL) <br />(attached) � { <br />Sincerely yours, <br />HARLAND D. BU RCHAM <br />Recording Secretary Local 19 <br />Whereas,, open and unprotected gravel pits have proved themselves a great menace to public safety, particularly to <br />children,,having within the past eight months taken the lives.of five children in this vicinity; one in South Bend, <br />two in Ardmore and two in Elkhart. Cdunty- -the two dying in the pits in Ardmore 'being Children of Members of Local <br />+9, UA'NA, and <br />Whereas, these gravel pits are privately owned and are operated for private profit; and although they are on private <br />land they are obviously attractive to the adventurous spirit of youth, which fact is not considered by the owners, <br />who do not take sufficient caution against children being attracted to them, now therefore, <br />Be It Resolved, that Local 1�9 UAWA, demand from our State Legislature laws to enforce the erection of woven wire <br />fences at least six feet in height to be placed around all gravel pits within the State of Indiana, and that such <br />fences have gates with secure locks upon them. And further <br />That the recording secretary of Local #9 be instructed to send copies of this resolution to the City Councils of al <br />Cities in this area, to candidates for office in the General Assembly, and to the secretary of the S +ate Industrial <br />Union Council, Indiana <br />Signed - <br />HARLAND D. Pavey <br />Mayor, City of South Bend <br />South Bend, Indiana' <br />Dear Sir: <br />. <br />In accordance with a resolution adopted by our_body at the regular meeting held Monday, April 8, 1940, I am sending <br />„you herewith copies of the resolution.. <br />We are asking your assistance in seeing that this reaches the proper person or persons to put it before your City <br />Council, and further to see that the necessary preliminary steps are taken towards the erection of a Housing Project <br />in this vicinity. Councilman Bishop seconded <br />the motion. Motion carried. <br />Councilman Pulaski made a verbal report of the Ordinance Committee on the anti -noise ordinance and made a motion <br />that the ordinance be placed on the table. Councilman Bishop seconded the motion. Motion carried by a vote of <br />8 ayes - 1 nay (Heideman) <br />REPORT OF THE COMMITTEE OF THE WHOLE <br />To the Common Council of the City of South Bend: May 27, 1940 <br />Your Committee of the Whole to whom was referred "This Ordinance is amendatory of Ordinance #2331, adopted by the <br />Common Council of the City of South Bend, Indiana, on June 25, 1923, commonly known as the Zoning Ordinance. <br />Respectfully report that they have examined the matter and that in their opinion this ordinance shall be given the <br />favorable consideration of the Council. <br />(Lots 54 & 55 Augustine's Addition and Lot 4 ?'boon's Addition) <br />LEO M.
