196 <br />ORDINAI%TCE 33/y <br />AN ORDINANCE RATIFYING, CONFIRMING AND APPROVING A CERTAIN CONTRACT AND AGREEMENT MADE <br />AND ENTERED INTO BY AND BET71,'EEY THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH ITS <br />BOARD OF PUBLIC ZIORKS ANT? SAFETY AND NORTHERN INDIANA TRANSIT, INC., ITS SUCCESSORS <br />AND ASSIGNS, VvF_ICH SAID CONTRACT RELATES TO THE OPERATION OF VEHICLES, C9_,U.RONLY KNOWN <br />AS MOTOR BUSSES, FOR THE PURP08E OF CARRYING PASSENGERS UPON, OVER AND ALOTTG CERTAIN <br />STREETS AND HIGHWAYS TIT SAID CITY. <br />This ordinance was given first reading by title.and second reading in full. Councilman Niezgodski made a motion <br />to suspend the rules. Councilman Bishop seconded the motion. Motion carried by vote of 9 ayes - 0 nays. The <br />ordinance was given third reading. Councilman Richardson made a motion that the contract be ratified and returned <br />to the Board of Works. Councilman Brannon seconded the motion. Motion passed by roll call vote of 9 ayes - 0 nays, <br />Clyde E. Williams, President of the Board of Works, addressed the Council and advised that certain verbal agree- <br />ments were made by the Northern Indiana Transit, Inc., with the Board of Works, which agreements are set out in <br />a Resolution (copy of which was miven to the Clerk of the Council). Mr. Williams suggested that this Resolution <br />be spread on the records of the Council. <br />RESOLUTION <br />That Whereas, hearings have been held by this Board upon the proposal to enter into a contract between the City of <br />South Bend and Northern Indiana Transit, Inc., which contract is intended to carry out the purpose of the City to <br />obtain the substitution of motor busses for street cars, and during said hearings said corporation has agreed to <br />make certain rates independent of said contract; that it will before June 15, 1940 file a schedule of rates with <br />the Public Service Uommission whereby it agrees to carry school children of the public and parochial schools of <br />said City during school hours and on school days at a .rate of five cents, and that it will sell to all riders seven <br />tokens (giving the right to seven rides) for fifty cents. <br />Therefore,.thzs Board finds that with said understanding said contract as published in the South Bend Tribune and <br />The Mirror Press should be executed by the City, and it is so ordered, and this Board further recommends that said <br />corporation should be permitted to operate upon the rates stated in said contract and upon the above rates a reason- <br />able time without the same being questioned. <br />CLYDE E.. BEAMER ) <br />Councilman Pulaski made a motion that the above Resolution as read be spread on the records of the City Council, <br />Councilman Jordan seconded the motion. Motion carried by a vote of 9 ayes - 0 nays. <br />Councilman Heideman requested that the anti -noise ordinance be given consideration. <br />Councilman Jordan stated that he has had several citizens suggest to him that the lampposts in the central part of <br />the city should be more ornamental and decorative. Therefore, Councilman Jordan made a motion that the Streets & <br />Alleirs Committee be instructed to contact the Indiana and Michigan Electric Company in regard to the matter. <br />Councilman Pulaski seconded the motion.
