1316 COUNTY -CITY BUILDING
227W JEmRwN BouLEvARD
SOUTH BEND, INDIANA 46601 -1830
CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR
BOARD OF PUBLIC WORKS
July 23, 2013
Mr. James Masters
Nemeth, Feeney, Masters & Campiti, PC
Chase Tower, Suite 1800
211 West Washington Street
South Bend, Indiana 46601
PI-IoNE 574/ 235 -9251
FAx 5741235 -9171
RE: Alley Vacation —the First North/South Alley (Otsego Street) East of Main Street bounded by
Wayne Street on the North and Western Avenue on the South (Preliminary Review)
Dear Mr. Masters:
At its July 23, 2013 meeting, the Board of Public Works reviewed comments by the Engineering
Department; Area Plan Commission, Community Investment, Fire Department, and the Police
Department. The following comments and recommendations were submitted:
Area Plan stated that the vacation would not hinder the growth or orderly development of the unit
or neighborhood in which it is located or to which it is contiguous. The vacation would not make access
to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation
would not hinder the public's access to a church, school or other public building or place. The vacation
would not hinder the use of a public right of way by the neighborhood in which it is located or to which it
is contiguous. The Redevelopment Commission stated they own six (6) parcels that abut the alley and
vacating the alley would land -lock the access from the alley to their parcels. Therefore, the Board
previously tabled this request to review other options.
After discussion between you, the Redevelopment Commission, and the Board of Public Works,
all parties agreed the best resolution is to vacate the entire alley, and provide the City with a cross - access
agreement. Therefore, the Board of Public Works submitted a favorable recommendation for the vacation
of this alley, subject to a cross - access agreement for the City to access the Redevelopment -owned lots.
The City agreed to allow the Library to landscape the vacated alley portion
Please contact Tony Molnar at (574) 235 -9254 prior to nicking up your radius man You
will need a radius map showing properties within 150' of the proposed vacation for your petition to the
Common Council. Once you pick up the radius map, proceed to the City Clerk's office for your alley
vacation packet.
Sincerely,
nda M. Martin, C r
c.
