t <br />ORDINANCE NO. 93 U-2K <br />AN ORDINANCE APPENDING CHAPTER 20, ARTICLE 3, <br />COMMONLY KNOWN AS THE ABANDONED VEHICLE <br />ORDINANCE <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of South Bend recognizes that abandoned <br />vehicles on private property are a scenic blight and hereby declares <br />them to be a public nuisance. The purpose and intent of this <br />Amendment is to extend the City's authority to remove and dispose <br />of such vehicles. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 20, Article 3 of the "1unicipal Code of <br />the City of South Bend, Indiana, is hereby amended as follows: <br />ARTICLE 3. ABANDONED VEHICLES. <br />Sec. 20 -27 Legislative Findings; Nuisance Declared; Public <br />Agency Designated; Revolving Fund Established. <br />(c) The Board of Public Wevke Safety is hereby designated the <br />public agency responsible for the removal, storage, and disposal of <br />abandoned and junk vehicles. Said Board may enter into contracts <br />with private towing firms, scrap processors, or auto wreckers to <br />provide the equipment and facilities for removal and disposal. <br />Sec. 20 -23 Definitions. <br />(5) Any vehicle from which there has been removed the engine or <br />transmission or differential or which is otherwise partially dis- <br />mantled or inoperable and left on public property, or left unattended <br />on private property in a location visible from public property. <br />( 7) Any vehicle that is over five (5) .years old and mechanically <br />inoperable, and is left unattended on private property in a location <br />which is visible from public property for more than thirty 30 days. <br />SECTION II.
