ORDINANCE NO. (,3(0S -)S <br />AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 5, OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND BY <br />THE ADDITION OF SECTION 2 -60 ENERGY CONSERVATION <br />COMMISSION <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes the <br />need to devise and implement a comprehensive energy conservation <br />program. The Council believes that local governments should play <br />an important role in pioneering energy efficient procedures in the <br />hope of conserving our dwindling natural resources. <br />The Council believes that the creation of an Energy Conser- <br />vation Commission would be able to effectively coordinate energy <br />conservation programs and policies which would serve the public <br />interest and act as a model to other governmental units. <br />Therefore, in the interest of using our natural resources <br />in a more efficient manner and in furthering the health, safety <br />and welfare of our community, the following bill is introduced. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of <br />the City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 5 of the Municipal Code of <br />the City of South Bend, Indiana, is hereby amended by the addition <br />of Section 2 -60 which shall read in its entirety as follows: <br />SEC. 2 -60, ENERGY CONSERVATION COMMISSION <br />(a) Legislative Findings. The South Bend Common Council <br />hereby finds that a strong energy conservation program is needed <br />to meet the present and future energy needs of our community. <br />(b) Establishment. It is hereby declared that the estab- <br />lishment of an Energy Conservation Commission is in the public in- <br />terest of the City of South Bend. <br />(c) Composition. The Commission shall be composed of fif- <br />teen (15) members, nine (9) of whom shall be appointed by the Coun- <br />cil, and six (6) of whom shall be appointed by the Mayor. The <br />Commission shall be broadly representative of the community. Each <br />member shall have either a professional interest or background in <br />the area; or have a sincere interest in the goals and objectives <br />of energy conservation. <br />(d) Terms of Members. The members of the Commission shall <br />serve three -year terms as members; however the first commission <br />shall have one -third of its membership appointed for a three -year <br />term, one -third for a two -year term, and one -third appointed for a <br />one -year term. The first commission shall have two (2) members <br />selected by the Mayor for each of the one, two, and three year <br />terms; and the Council shall select three (3) members for each of <br />the one, two and three year terms. <br />(e) Compensation; quorum. All members of the Commission <br />shall serve without compensation and any eight (8) members shall <br />constitute a quorum. <br />
