<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the
<br />Whole in the Council Chambers in City Hall, on Monday, November 13, 1967, at 8:00 P.M., with all members
<br />present except Councilmen Palmer and Muszynski. The meeting was called to order by Chairman Edwin T.
<br />Smith, who presided. Chairman Smith introduced Reverend Gary Hesser, First Christian Church, who gave
<br />the invocation.
<br />ORDINANCE
<br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE
<br />NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE
<br />MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET
<br />SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE
<br />COMMON COUNCIL BY ORDINANCE NO. 4608 -63.
<br />(Location: N.W. Corner of Bendix and Elwood).
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and ® oponents
<br />were given an opportunity to be heard thereon. Public hearing had been continued from the meeting of
<br />October 9, 1967. The following report from the Capital Improvement Committee was read by Councilman
<br />Janet S. Allen:
<br />To the Common Council of the City of South Bend:
<br />Your Committee on Capital Improvements to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING
<br />ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER
<br />40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND-ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63
<br />(Location: N.W. Corner of Bendix and Elwood).
<br />Respectfully report that they have examined the matter and that in their opinion the Ordinance is
<br />hereby recommended unfavorably by a 3 to 2 vote of the Committee.
<br />The following points were reviewed:
<br />1. South Shore Railroad delivery of lumber:
<br />No set time could be established for delivery.
<br />2. Status of FHA financing of houses in the area:
<br />Probably only 40% on houses, as against the normal. 90%
<br />3. South Bend Code on treatment of stored lumber:
<br />Non - combustion treatment is required in #1 Fire
<br />Zone, once a year. There is always a fire hazard.
<br />No written report, as requested, was received from
<br />Mr. Dillon.
<br />4. Check out Real Estate values:
<br />"Doubt as to whether it would either help or hurt ".
<br />5. Possibility of rats and vermin:
<br />No more infestation than in any other industrial operation.

<br />The report was accepted, as read, and placed on file.
<br />Councilman Hunter then read a communication from Mr. Robert Craft, Executive Director of the Indiana
<br />Building and Supply, in which Mr. Craft expressed doubt as to whether any rats would infest an area such
<br />as that proposed in the ordinance. Speaking in favor of the Ordinance was Gerald Feeney, attorney for
<br />the petitioner. Speaking against the Ordinance were: Edward Kalamaros, Attorney, representing nearby
<br />property owners who are not in favor of the Ordinance; George Flake, 1508 N. Iowa St; Elaine Flake,
<br />1508 N. Iowa St.; Stanley Klabor, 1609 N. Iowa St.; and Joseph Meyer, 1512 N. Iowa St. Councilman Geib
<br />made a motion to recess. Councilman Laven seconded the motion. Motion carried. Time: 8:30 P.M.
<br />Reconvened: 8:40 P.M. Councilman Hunter made a motion that public hearing be continued until November 27,
<br />1967, at which third reading would be given the Ordinance. Councilman Arlen seconded the motion. Motion
<br />carried.
<br />ORDINANCE
<br />AN ORDINANCE DETERMINING THAT IT IS NECESSARY FOR
<br />THE CITY OF SOUTH BEND TO CONDEMN CERTAIN REAL
<br />ESTATE FOR THE USE AND BENEFIT OF "MEMORIAL
<br />HOSPITAL OF SOUTH BEND ", AND THAT THE ACQUISITION
<br />OF SAID REAL ESTATE IS NECESSARY FOR THE
<br />EXPANSION OF SAID HOSPITAL.

<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents
<br />were given an opportunity to be heard thereon. Speaking in favor of the Ordinance were: Bruce Hammerschmidt,
<br />attorney, and member of the Board of Directors of Memorial Hospital and Richard Trenkner, Memorial Hospital
<br />Administrator. Speaking against the Ordinance was Joseph V. Simeri, Attorney, representing the owners
<br />of the property in question. Councilman Laven made a motion to recess. Time: 9 :45PM.Reconvened 10:15 P.M.
<br />Councilman Geib made a motion that a special session of the Council be called for Monday, November 20, 1967,
<br />at 8:00 A.M., at which time public hearing would be continued and third reading given the Ordinance.
<br />Councilman Hunter seconded the motion. Motion carried.
