<br />Gentlemen:
<br />The attached rezoning petition of American Realty of South Bend, Inc. was legally advertised under date of Jan-
<br />uary 7 and 14, 1967 and given public hearing on January 17, 1967. The following action was taken:
<br />After due consideration it was moved, seconded and carried that the proposed
<br />ordinance and site development plan be recommended favorably to the Common Council
<br />subject to the review and approval of the site development plan by the City Traffic
<br />Engineer.
<br />The deliberations of the Area Plan Commission and points considered in arriving at the above decision are
<br />shown in the excerpts of the minutes attached hereto and made a part of this report.

<br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO.
<br />3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL
<br />CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED
<br />AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE
<br />NO. 4608 -63 (North side of Jefferson Blvd more commonly known
<br />as 3000 East Jefferson Blvd., South Bend, Indiana)
<br />The Ordinance was given third reading and passed by a roll call vote of 9 ayes (Councilmen Hunter, Allen,
<br />Palmer, Wise Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays, 0 absent.

<br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE
<br />NO. 3702 as HERETOFORE AMENDED AND SUPPLEMENTED AND THE
<br />MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ.,
<br />AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON
<br />COUNCIL BY ORDINANCE NO. 4608 -63 (Location: Southwest
<br />corner of U.S. 31 and Angela Blvd)
<br />The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion
<br />that the Ordinance be set for public hearing on February 27, 1967. Councilman Palmer seconded the motion.
<br />Motion carried.
<br />ORDINANCES, FIRST AND SECOND READING
<br />AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS
<br />OF SOUTH BEND, INDIANA CERTAIN LANDS AND PROVIDING, AFTER
<br />ANNEXATION SHALL TAKE EFFECT, THAT FOR A PERIOD OF THREE
<br />YEARS ONE -HALF (2) OF THE MUNICIPAL PROPERTY TAXES TO BE
<br />IMPOSED UPON THE ANNEXED TERRITORY SHALL BE IMPOUNDED AND
<br />PLACED IN A SPECIAL FUND SOLELY FOR THE BENEFIT OF THE
<br />ANNEXED TERRITORY. (Location: A tract of land bounded on
<br />the North by Ireland Road,on the West by U.S. 31 (South
<br />Michigan St.) on the South by U.S. 31 interchange and the
<br />Jackson High School property, on the East by Miami Road)
<br />The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion
<br />that the Ordinance be set for public hearing on February 27, 1967. Councilman Szymkowiak seconded the motion.
<br />Motion carried.
<br />ORDINANCES, FIRST AND SECOND READING
<br />ORDINANCE NO. 4910 -67
<br />AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA,
<br />AUTHORIZING THE MAKING OF A TEMPORARY LOAN FOR
<br />THE GENERAL FUND AND THE ISSUANCE AND SALE OF
<br />WARRANTS OF THE CITY FOR SUCH PURPOSE.
<br />The Ordinance was given first reading by title and second reading in full. Councilman. Smith made a motion
<br />for suspension of rules. Councilman Wise seconded the motion. Motion carried by a roll call vote of 9 ayes
<br />(Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski), 0 nays.
<br />City Controller, James A. Bickel spoke in favor of the Ordinance.
