j86 <br />COMMITTEE OF THE WHOLE MEETING SEPTEMBER 26 1966 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers in the City Hall on Monday,Beptember 26, 1966. The meeting was called to order by <br />Chairman Edwin Thomas Smith, who presided. All members were present. Time: 8:00 P.M. <br />Chairman Smith introduced Reverend Charles Ellinwood, St. Pauls Methodist Church, who gave the Invocation. <br />ORDINANCE <br />AN ORDINANCE AMENDING SECTIONS 40 -1 AND 40 -17 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br />1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 3702, <br />THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, <br />AS AMENDED. <br />Douglas Seely, Attorney spoke in favor of the Ordinance, but requested that the Council continue public hearing <br />in two weeks, after those persons concerned with it, have had more time to study it. John K. Wilson, <br />Executive- Director of the Area Plan Commission concurred with Mr. Seeley that the public hearing should <br />be continued so that it will receive more publicity. Councilman Hunter made a motion that the Ordinance be <br />referred to the Ordinance Committee, and that the public hearing be continued until October 10, 1966. <br />Councilman Palmer seconded the motion. Batey, Lynndon E. Scheid, Sylvia Pence <br />and Lottie Torzewski to rezone a tract of land located south of Lincoln Way East, West of Twyckenham Drive, <br />East of Hilde's Court and North of an east and west alleyway bisecting the block in an east west direction, <br />in the City of South Bend, Indiana <br />Respectfully submitted <br />/s/ Russell H.Fisher <br />Attorney for petitioners <br />Councilman Allen made a motion that the letter be accepted and placed on file. Councilman Szymkowiak seconded <br />the motion. Motion carried. <br />Councilman Hunter made a motion to recess. Councilman Wise seconded the motion. Motion carried. Time: 8 :15 <br />Reconvened 8:25. Upon advice of Robert J. DuComb, City Attorney, it was decided that although the letter was <br />accepted, as read, the Ordinance would not be withdrawn. <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED <br />BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS <br />THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Location: South of.L.W.E., West <br />of Twyckenham) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Councilman Hunter made a motion that the Ordinance go to the <br />Council as unfavorable. Councilman Wise seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, <br />AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 3702, THE <br />ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, <br />AS AMENDED. (Location: 3900 block S. Michigan) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given <br />an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the Council as <br />favorable. Councilman Muszynski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE <br />CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS. <br />Location: East side of York Rd., south of the <br />center line of Jackson Road.). <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given <br />an opportunity to be heard thereon. Councilman Geib reported that the Annexation Committee recommended the <br />annexation favorable. Lloyd Taylor, City Engineer spoke in favor of the Ordinance. Councilman Hunter made a <br />motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. <br />
