<br />COMMITTEE OF THE WHOLE MEETING APRIL 11, 1966
<br />Be it remembered that the Common Council of the City of South Bend, Indiana,met in the Committee of the Whole
<br />in the Council Chambers in the City Hall on Monday, April 11, 1966 at 8:10 P.M., with all members present.
<br />The meeting was called to order by Chairman Edwin T. Smith, who presided.
<br />ORDINANCE
<br />AN ORDINANCE REPEALING SUB- SECTION (b) OF SECTION
<br />ONE (1) OF ORDINANCE NO. 3964 BEING AN ORDINANCE
<br />FIXING THE SCHEDULE OR RATES AND CHARGES TO BE
<br />COLLECTED BY THE CITY OF SOUTH BEND FROM THE
<br />OWNERS OF PROPERTY SERVED BY THE SEWAGE DISPOSAL
<br />WORKS OF SAID CITY AND OTHER MATTERS CONNECTED
<br />THEREWITH: AND SUBSTITUTING A NEW SUBPARAGRAPH
<br />(b) IN SAID SECTION ONE (1) IN LIEU THEREOF.
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Mr. Dick Biscomb of the Area Chamber of Commerce spoke against
<br />passage of the Ordinance at this time, asking that voting be delayed until further studies have been made.
<br />Also speaking against the Ordinance was Don Carter, speaking in behalf of the Bendix Corporation. Mr. Howard
<br />Goodhew, Water Works Superintendent spoke in favor of the Ordinance. Councilman Geib made a motion that
<br />public hearing on this Ordinance be continued April 25, 1966, and that third reading be given at that time.
<br />Councilman Muszynski seconded the motion. Motion carried.
<br />ORDINANCE
<br />AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING A
<br />COMMUNITY ANTENNA TELEVISION FRANCHISE AGREEMENT
<br />BETWEEN THE BOARD OF PUBLIC WORKS AND SAFETY OF
<br />THE CITY OF SOUTH BEND AND VALLEY CABLEVISION
<br />CORPORATION.
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. Louis Chapleau, attorney
<br />for Valley Cablevision Corporation. Speaking against the Ordinance was Tom Laughlin, who appeared in behalf
<br />of Community Television. Also speaking in favor of the Ordinance, was Jerry Kunkle, Program Director of
<br />W A T V, of Indianapolis, Indiana. Mr. Chapleau then spoke in rebuttal. Mr. Laven made a motion that the
<br />Ordinance be tabled , and a communication be sent the Board of Public Works asking that the franchise
<br />be amended to provide for a rate review procedure. Councilman Szymkowiak seconded the motion. Motion lost
<br />4 nays,(Geib, Hunter, Allen and Muszynski), Z5 ayes, (Laven, Szymkowiak, Palmer, Smith and Wise). Councilman
<br />Geib made a motion that the Ordinance be sent to the Council as unfavorable. Councilman Hunter seconded the
<br />motion. Motion defeated, 3 ayes (Councilmen Hunter, Allen and Geib) 6 nays (Councilmen Palmer, Wise, Szymkowiak,
<br />Laven, Smith and Muszynski). Councilman Wise made a motion that the public hearing be continued until
<br />April 25, 1966. Motion died.for lack of a second. Councilman Wise made a motion for recess. Councilman
<br />Allen seconded the motion. Motion carried. Time: 9:50 P.M. Reconvened 10:10 P.M. Councilman La #en made
<br />a motion that the Ordinance go to the Council as unfavorable, and that a statement would be made at the end
<br />of the meeting under New Business. Motion carried, 8 ayes, 1 nay (Councilman Szymkowiak).
<br />ORDINANCE
<br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE
<br />CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED,
<br />ALSO KNOWN AS ORDINANCE NO. 4563, THE SUBDIVISION
<br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. Martin Kleva of the
<br />Area Plan Commission. Councilman Hunter made a motion that the Ordinance be amended in Section 1, Part
<br />5, line 2, to read 1 year instead of 30 days. Councilman Palmer seconded the motion. Motion carried.
<br />Councilman Muszynski made a motion that the Ordinance go to the Council favorable, as amended. Councilman
<br />Hunter seconded the motion. Motion carried.
<br />ORDINANCE
<br />AN ORDINANCE AMENDING SECTION 40 -19 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, 1962, AS AMENDED.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were
<br />given an opportunity to be heard thereon.Speaking in favor of the Ordinance was Mr. Martin Kleva of the
<br />Area Plan Commission. Councilman Hunter made a motion that the Ordinance go to the Council as favorable.
<br />Councilman Muszynski seconded the motion. Motion carried.

<br />AN ORDINANCE TRANSFERRING $80,974.23 FROM
<br />THE SOUTH BEND -ST. JOSEPH COUNTY BUILDING
<br />AUTHORITY FUND TO THE GENERAL FUND OF
<br />SOUTH BEND AND APPROPRIATING $80,974.23
<br />TO ACCOUNT L- 71- BUILDINGS, STRUCTURES
<br />AND IMPROVEMENTS, SAID ACCOUNT BEING IN
<br />THE GENERAL FUND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and opponents
<br />were given an opportunity to be heard thereon. Councilman Hunter made a motion that the Ordinance go to
<br />the Council as favorable. Councilman Wise seconded the motion. Motion carried.
