REGULAR MEETING <br />-- REGULAR _MARCH- _24��9b6 <br />PETITION <br />March 23, 1966 <br />I, the undersigned, do hereby respectfully make application and petition the Common Council of the <br />City of South Bend as hereinafter requested, and in support of this application, the following <br />facts are shown. <br />II 1. The property sought to be rezoned is located at 3000 East McKinley, South Bend, Indiana. <br />it <br />2. The property is owned by The Light Company <br />3. A legal description of the property is as follows: <br />Starting at a point 455k feet South of the Northwest corner of the Northeast Quarter of said <br />Section No. 8; thence running East 232 feet; thence North 117 feet; thence due East 125 feet; <br />thence due North to the center line of U.S. Highway No. 20 (McKinley Avenue); thence in a general <br />Northeasterly direction along said center line of said U.S. Highway 20 approximately 230 feet <br />to the East line of-petitioner's property; thence due South 280 feet; thence due West 175 feet to <br />petitioner's dedicated right -of -way: thence due South 600 feet along said right -of -way; thence 400 <br />feet in a Southeasterly direction on a 300 angle; thence due West approximately 540 feet to the West <br />line of the Northeast Quarter of Section 8; thence North along said line to the place of beginning. <br />4. It is desired and requested that the foregoing property be rezoned From A Residence District <br />a Use and A Height and Area District To C Commercial District Use and B Height and Area District <br />5. It is proposed that the property will be put to the following use and the following building <br />will be constructed. <br />At the resen <br />p t time no new buildings are contemplated, and existing structures and installations <br />will be continued. Some remodeling of the one principal structure shown on the Site Development <br />Plan will occur to facilitate the improvement of a portion of the structure as a club house, <br />restaurant, <br />and related uses to the golf course. A portion of the existing structurHiwill <br />be refurbished and _utilized for the sale of all types of home appliances, including, YP pp , u ing, but not <br />limited to, such things as refrigerators, television sets, gas ranges, etc. <br />6. Number of off street parking spaces to be provided: <br />The existing parking facilities available for the patrons of the golf course and present appliance <br />business will be adequate to handle future needs. <br />LIGHT COMPANY, INC. <br />By: Douglas D. Seely, ar., Its Attorney <br />Councilman Laven made a motion that the petition be referred to the Area Plan Commission. Councilman <br />Palmer seconded the motion. Motion carried. <br />PETITION <br />March 23, 1966 <br />We, the undersigned, do hereby respectfully make application and petition the Common Council of the <br />City of South Bend to amend the zoning Ordinance of South Bend, Indiana as hereinafter requested, <br />and in support of this application, the following facts are shown: <br />1. The property sought to be rezoned is located at <br />the easterly side of York Road add commences approximately 400 feet south of the south line of <br />Jackson Road in South Bend, Indiana. <br />2. The property is owned by Crest Manor Development Corp. but is being purchased on contract by <br />Edward J. Sikora dnd Ora J. Stahl. <br />3. A legal description of the property is as follows: <br />A tract of land in the Northeast Quarter (k) of Section 31, Township 37 North, Range 3 East, Centre <br />Township, St. Joseph County, Indiana, more particularly described as follows: Beginning at a point <br />400 feet South of the Northwest corner of said Northeast Quarter W of said Section 31; thence <br />East a distance of 523 feet on a line 400 feet South of and parallel to the north line of said <br />Section 31, to the Northwest corner of the 4 -H Fairgrounds property; thence South a distance of <br />837.5 feet along the West property line of the Fairgrounds; thence West a distance of 523 feet <br />to the West line of said Northeast Quarter (k); thence North on the West line of said Northeast <br />Quarter (k) a distance of 837.5 feet to the Point of Beginning. <br />4. It is desired and requested that the foregoing property be rezoned: From A Residence Use and A <br />Height and Area District To: B Residence Use and A Height and Area District. <br />5. It is proposed that the property will be put to the following use and the following buildings will <br />be constructed. <br />A 180 -unit apartment project as more particularly disclosed on the site development plan which <br />will be submitted to the Area Plan Commission on or before the hearing on this petition. <br />6. Number of off street parking spaces to be provided: <br />Spaces for at least 270 vehicles. <br />(continued) <br />
