lim- REGULAR MEETING JANUARY 27 1964 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, January 27, 1964, at 8:27 P.M., with all members present except Councilman Palmer. The meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski. ABSENT: Councilman Palmer REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of January 13, 1964 Is/ Walter G. Glass ) Isl John L. Hunter Jr, ) Committee Isl Chester Muszynski ) Councilman Smith made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Place & Company, Inc. to rezone a tract of land West of Miami Road on the South side of Ireland Road from "B" Residential, "A" Height and Area District to "C" Commercial, "A" Height and Area District. Councilman Smith made a motion that the petition be referred to the City Plan Commission. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: December 11, 1963 The attached petition of Katherine Jennings to rezone from "D" Light Industrial Use and "F" Height and Area District to "B" Residential Use and "A" Height and Area District Lots 15, 16, 17 and 18 Linden Place Addition, being more generally described as being bounded on the east by College, on the south by Linden, on the west by Chicago, Indiana and Southern Railroad right -of -way, and on the north by the first east -west alley north of Linden was legally advertised under date of November 30, 1963 and given public hearing on December 10, 1963. The following action was taken: After due consideration the Commission found that the general area is in residential use, that the present industrial zoning is very questionable and that the present use of the subject area is residential. It was there= fore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Ilid%Ana Gentlemen: January 10, 1964 The attached petition of DeWitt Marshall,134 S. Dade Street, to rezone from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District Lot 615 Summit Place 3rd Addition, being more generally described as 142 S. Meade Street was legally advertised under date of December 30, 1963 and given public hearing on January 9, 1964. The following action was taken: After due consideration the Commission found that the favorable recommendation of the petition would result in spot zoning and therefore could devaluate the surrounding property, the rezoning would confer on the owner certain rights not enjoyed by other property owners and that the sole purpose of the rezoning was to allow the erection of an auto repair garage. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended unfavorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L.
