<br />REGULAR MEETING JANUARY 27 1964
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the
<br />Council Chambers in the City Hall on Monday, January 27, 1964, at 8:27 P.M., with all members present except
<br />Councilman Palmer. The meeting was called to order by President John L. Hunter Jr., who presided.

<br />PRESENT: Councilmen Hunter, Allen, Wise, Geib, Szymkowiak, Glass, Smith and Muszynski.
<br />ABSENT: Councilman Palmer
<br />REPORT OF COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
<br />inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
<br />that the same be approved.

<br />Councilman Smith made a motion that the report be accepted and placed on file. Councilman Muszynski seconded
<br />the motion. Motion carried.
<br />PETITION
<br />Petition of Place & Company, Inc. to rezone a tract of land West of Miami Road on the South side of Ireland Road
<br />from "B" Residential, "A" Height and Area District to "C" Commercial, "A" Height and Area District.
<br />Councilman Smith made a motion that the petition be referred to the City Plan Commission. Councilman Glass
<br />seconded the motion. Motion carried.

<br />December 11, 1963
<br />The attached petition of Katherine Jennings to rezone from "D" Light Industrial Use and "F" Height and Area
<br />District to "B" Residential Use and "A" Height and Area District Lots 15, 16, 17 and 18 Linden Place Addition,
<br />being more generally described as being bounded on the east by College, on the south by Linden, on the west by
<br />Chicago, Indiana and Southern Railroad right -of -way, and on the north by the first east -west alley north of
<br />Linden was legally advertised under date of November 30, 1963 and given public hearing on December 10, 1963.
<br />The following action was taken:
<br />After due consideration the Commission found that the general area is
<br />in residential use, that the present industrial zoning is very questionable
<br />and that the present use of the subject area is residential. It was there=
<br />fore duly moved, seconded, and unanimously carried that the petition be
<br />recommended favorably to the Council.

<br />January 10, 1964
<br />The attached petition of DeWitt Marshall,134 S. Dade Street, to rezone from "B" Residential Use and "A" Height
<br />and Area District to "C" Commercial Use and "A" Height and Area District Lot 615 Summit Place 3rd Addition, being
<br />more generally described as 142 S. Meade Street was legally advertised under date of December 30, 1963 and given
<br />public hearing on January 9, 1964. The following action was taken:
<br />After due consideration the Commission found that the favorable recommendation
<br />of the petition would result in spot zoning and therefore could devaluate the
<br />surrounding property, the rezoning would confer on the owner certain rights not
<br />enjoyed by other property owners and that the sole purpose of the rezoning was
<br />to allow the erection of an auto repair garage. It was therefore duly moved,
<br />seconded, and unanimously carried that the petition be recommended unfavorably
<br />to the Council.
