544 <br />COMMITTEE OF THE WHOLE MEETING MARCH 25, 1963 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in <br />the Council Chambers in the City Hall on Monday, March 25, 1963, at 8:10 P.M., with all members present. The meeti <br />was called to order by Councilman T. W. Lehman, Chairman, who presided. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 <br />(Land between Lincolnway West and Crumstown Avenue) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. <br />Councilman Ladewski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS AMENDED <br />(Land along the West side of Arnold Street) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an <br />opportunity to be heard thereon. Councilman Muszynski made a motion that the Ordinance go to the Council as favorab] <br />Councilman Kroll seconded the motion. Councilman Kroll made a motion that the Ordinance go to the Council as favorable. <br />Councilman Ladewski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, <br />(Relative to procedure of amendments) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given j <br />an opportunity to be heard thereon. Councilman Ladewski -made a.motion that the Ordinance go to'-the Couhcil as favor -! <br />able, Councilman Kroll seconded the motion. After discussion Councilman Ladewski withdrew his motion. Councilman <br />Kroll withdrew his second to the motion. Councilman Kroll made a motion that the Ordinance be referred to the <br />Ordinance committee for study and a report back to the Council in two weeks. Councilman Ladewski seconded the <br />motion. Motion carried. <br />ORDINANCE' <br />AN ORDINANCE FIXING THE ANNUAL SALARIES PAYABLE FROM THE GENERAL FUND, FOR <br />OFFICERS OF THE CITY OF SOUTH BEND, TO BE ELECTED FOR THE TERM COMMENCING <br />JANUARY 1, 1964, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT <br />The Clerk read the following communications: <br />Committee of the Whole <br />South Bend Common Council <br />South Bend, Indiana <br />Gentlemen: <br />March 22, 1963 <br />This Association wishes to point out that the new salary ordinance of the city of South Bend failed to meet the <br />statutory requirements, as set forth in Chapter 107 of the Acts of 1959, Section 6, Burns 48 -1233, pages 224 and 2259 <br />In our opinion corrective <iCetp'sy are required in order that elected city officials may draw their salaries during <br />their tenure in office beginning January 1, 1964. Should this serious error on the part of the city administration <br />go uncorrected, salary payments to these elected officials could be challenged by legal action initiated by any <br />citizen. It is, we believe, the duty of the administration to avoid such a hazard by immediate action. <br />We wish to see the action of the City Council fully and legally in effect. Salary increases reflected in the salary <br />ordinance have been long delayed with respect to the officials involved, and we believe the stature of these <br />particular positions merits recognition through more adequate compensation. It was noted that these salaries are <br />presently below those of other Indiana cities of our size. <br />It was the unanimous recommendation of our Directors that: <br />
