JOSEPH COUNTY, INDIANA,(South.of Pokagon and Northwest of State Road 31) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE NO. 4371 - - -61 AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA (South of Angela and North of Pokagon) The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: March 23, 1961 The attached proposed ordinance originated by the Common Council to annex to the City of South Bend, Indiana, the property generally described as bounded on the north by the east -west center section line of Sections 28 and 29 T. 38 N., R.2 E, and the Indiana Toll Road; on the east by Portage Avenue and the present City Limits; on the south by the present City Limits and Lincolnway West and on the west by Butternut Road, containing approximately 1,544 acres was legally advertised on February 28, 1961 and given two public hearings under the dates of October 27, 1960 and March 2, 1961. In addition to the public hearings two meetings were held between the Planning Commission's Committee on Annexation and a committee of residents from the proposed annexation area. The following action was taken: After due consideration the Commission found that in their opinion: 1. The annexation is in the best interests of the city and of the territory to be annexed. 2. The area is urban in character, being an economic and social part of the annexing city. 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future. 4. The area sought to be annexed is needed for development of the city in the reasonably near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably_ to the Common Council. Very truly yours, CITY PLANNING COMMISSION Is/ Robert L. REPORT OF THE CITY PLANNING COMMISSION The Honorable Common Council March 24, 1961 City of South Bend South Bend, Indiana Gentlemen: The attached petition of Marjorie Drinski to rezone a part of Lot Numbered Five (5) as shown on the recorded plat of ` Burrough's Subdivision of Bank Out Lot One Hundred Fifteen (115) of the Third Plat of the Out Lots to the Town, now City of South Bend, described as follows: Beginning at a point Sixty -four (64) feet south of the northwest corner of said Lot Numbered 5 thence south a distance of Thirty -seven and One Tenth (37.1) feet, thence southeasterly a distance of One Hundred Fifty -seven (157) feet, thence northeasterly on the south boundary line of said Lot Numbered Five (5) a distance of Two and Five Tenths (2.5) feet, thence north to a point directly east of the place of beginnin thence west a distance of Seventy -three (73) feet to the place of beginning which said description also includes the south portion of the west one -half of the vacated alley lying east of and adjoining said Lot Numbered Five (5), excepting therefrom that part of said lot taken for the opening of William Street, from "C -1" Commercial Use District to "C" Commercial Use District was legally advertised under date of February 20, 1961 and given public hearing under date of March 2, 1961. After due consideration the Commission found there to be a lack of demonstrated need for additional "C" Commercial
