Staff Report 6/5/2013 <br />APC # 2675 -13 <br />Owner: APC Initiated <br />Location: Text Amendment <br />Jurisdiction: City of South Bend <br />Public Hearing Date: 6/18/2013 <br />Requested Action: <br />The requested action is a text change, amending Chapter 21 of the South Bend Municipal <br />Code, Article 5 Planned unit Development District, Section 21 -05 Planned Unit <br />Development District, to revise the criteria used in determining major /minor changes to <br />approved site plans and removing the limits to obtain secondary approval. <br />Zoning and Land Use History And Trends: <br />In 2009 the Area Plan. Commission initiated an ordinance to amend the criteria used in <br />determining major /minor changes to approved site plans, and.removing the time limits to <br />obtain secondary approval for PUDs. The Area Plan Commission sent it with a favorable <br />recommendation to the Common Council. It was tabled at the Council Committee meeting <br />and later withdrawn in order to review the comments made by the Council members and <br />craft a revised ordinance. The proposed ordinance has been revised to address those <br />comments. <br />Staff Comments: <br />It is not uncommon for large developments typically using the PUD District to take longer <br />than 3 -5 years to fully develop. Limiting the time that final developments can be approved <br />has no additional public benefit since all requirements of the PUD must be adhered to. <br />Recommendation: <br />Based on information available prior to the public hearing, the staff recommends that the <br />petition be sent to the Common Council with a favorable recommendation. <br />Analysis: <br />Planned Unit Developments are large, multi -year projects which typically take a long time to <br />complete. Limiting the time that final developments can be approved has no additional <br />public benefit since all requirements of a PUD must be adhered to. Therefore, staff sees no <br />need to impose a time limit. The proposed text amendment will also allow the addition of <br />driveways or access points to be considered a minor modification that may be authorized by <br />the Executive Director without a public hearing. <br />APC # 2675 -13 Page 1 of 1 <br />
