INDIANA 46601 (574) 235 -9571 <br />Wednesday, June 19, 2013 <br />The Honorable Council of the City of South Bend <br />4th Floor, County -City Building <br />South Bend, IN 46601 <br />RE: An Ordinance initiated by the Area Plan Commission on behalf of the Common Council of the City of <br />South Bend, Indiana, amending Chapter 21 of the South Bend Municipal Code, Article 5 Planned Unit <br />Development District, Section 21 -05 Planned Unit Development District, to revise the criteria used in <br />determining major /minor changes to approved site plans and removing time limits to obtain secondary <br />approval, City of South Bend - APC# 2675 -13. <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance initiated by the Area Plan Commission was legally advertised <br />on Monday, May 06, 2013 and that the Area Plan Commission at its public hearing on Tuesday, June 18, 2013 took <br />the following action: <br />Upon a motion by John DeLee, being seconded by Michael Mecham and unanimously carried, the <br />Ordinance initiated by the Area Plan Commission on behalf of the Common Council of the City of <br />South Bend, Indiana, amending Chapter 21 of the South Bend Municipal Code, Article 5 Planned <br />Unit Development District, Section 21 -05 Planned Unit Development District, to revise the criteria <br />used in determining major /minor changes to approved site plans and removing time limits to <br />obtain secondary approval, City of South Bend, is sent to the Common Council with a favorable <br />recommendation. Planned Unit Developments are large, multi -year projects which typically take a <br />long time to complete. Limiting the time that final developments can be approved has no <br />additional public benefit since all requirements of a PUD must be adhered to. Therefore, the Commission <br />sees no need to impose a time limit. The proposed text amendment will also allow the addition of <br />driveways or access points to be considered a minor modification that may be authorized by the <br />Executive Director without a public hearing. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above decision are <br />shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of <br />this report. <br />Sincerely, <br />ClAnW w. . <br />n .
