St. <br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, <br />Szymkowiak, Wise, Palmer and Zielinski <br />ABSENT: None <br />RESOLVE INTO THE COMMITTEE OF THE WHOLE <br />Council President Laven entertained a motion to resolve the Council into the Committee of the <br />Whole on the state of the City to consider the items listed on the agenda for the considera- <br />tion of the Committee of the Whole. Councilman Wise so moved and Councilman Craven seconded <br />the motion. Motion carried. Time: 8:10 P. M. <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Com- <br />mittee of the Whole in the Council Chambers of the County -City Building on Monday, July 12, <br />1971, at 8:11 P. M., all members present. The meeting was called to order by Chairman <br />William W. Grounds, who presided. <br />nPnTNAWrR <br />AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES <br />FOR SERVICES RENDERED BY THE WASTEWATER TREATMENT PLANT OF <br />THE CITY OF SOUTH BEND TO AREAS OUTSIDE THE CORPORATE <br />LIMITS OF THE CITY OF SOUTH BEND <br />This being the time heretofore set for the continuation from the June 28, 1971 meeting on the <br />above ordinance, proponents and opponents were given an opportunity to heard thereon. City <br />Controller James Bickel said the ordinance was to fix sewage charges for residents outside <br />the City. Councilman Laven made a motion, seconded by Councilman Szymkowiak, to change the <br />figure from 120/ to 150°/. Motion carried. Councilman Laven made a motion, seconded by <br />Councilman Szymkowia% that the ordinance go to Council favorable as amended. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING CHAPTER 40 OF THE MUNICIPAL CODE OF ' <br />THE CITY OF SOUTH BEND, INDIANA, 1963, ALSO KNOWN AS ORDI- <br />NANCE NO. 3702 AS AMENDED, THE ZONING ORDINANCES OF THE <br />CITY OF SOUTH BEND (123 East Ireland Road) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney Bruce Stewart stated the <br />ordinance was to rezone from "A" Residential Use to "C" Commercial Use with no change from "A" <br />Height and Area District for the demolition of the present gasoline service station and to <br />construct a new building, install new landscaping and extend into the property to the east. <br />The Area Plan Commission suggested that new plans show the drainage facilities and curb around <br />the eastern portion of the property. The site plan presented to the Area Plan Commission on <br />June 15, 1971 did not show drainage. They approved the rezoning subject to the petitioner <br />showing the drywells on the site plan. Drawings were shown to the Council. Councilman Laven <br />suggested that if the Area Plan Commission and City Engineer can accept this as it is, we <br />could postpone the public hearing until later on in the meeting. Councilman Craven proposed that <br />the item be moved down to after Item 7 and Councilman Grounds /_,pr°potfiat it be set down to <br />after Item 9. Councilman Allen moved that public hearing be held over until July 26, 1971, <br />seconded by Councilman Zielinski. Motion carried. <br />
