r- r. <br />-.J W <br />SPECIAL MEETING JUNE I'7_.,,, 1971 <br />SPECIAL MEETING <br />ROLL CALL <br />(Continued) <br />PRESENT: Councilmen Laven, Allen, Craven, Grounds, Wise, Reinke and Szymkowiak <br />ABSENT: Councilmen Palmer and Zielinski <br />A public_ hearing -was held at this time on the following resolution: <br />RESOLUTION NO. 277 -71 <br />RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, APPROVING THE UNDERTAKING OF SURVEYS AND PLANS FOR <br />AN URBAN RENEWAL PROJECT AND THE FILING OF AN APPLICATION <br />WHEREAS, under Title I of the Housing Act of 1949, as amended (herein referred to as <br />"Title I "), the Secretary of Housing and Urban Development is authorized to extend financial <br />assistance to local public agencies in the elimination and prevention of the spread of their <br />slums and urban blight through the planning and undertaking of Urban Renewal projects; and <br />WHEREAS, it is desirable and in the public interest that the City of South Bend, <br />Department of Redevelopment make surveys and prepare plans, presently estimated to cost ap- <br />proximately .four hundred and twelve thousand, seven hundred and six ($412,706) dollars in order <br />to undertake and carry out an urban renewal project of the character contemplated by Section <br />110 (c) of Title I in the proposed Urban Renewal Area, situated in the City of South Bend, <br />County of St. Joseph and State of Indiana, which is described as follows: <br />Beginning at a point formed by the intersection of the west right -of -way line of <br />Olive Street and the north right -of -way line of the first alley north of Kenwood <br />Street; thence in an easterly direction on the north right -of -way line of said al- <br />ley to the east right -of -way line of Huey Street; thence in a southerly direction <br />along the east right -of -way line of Huey Street to the north right -of -way line of <br />Kenwood Street; thence in an easterly direction along the north right -of -way of Ken - <br />wood Street to the east right -of -way line of Johnson Street; thence in a southerly <br />direction along the east right -of -way line of Johnson Street to the north right -of- <br />way line of the first alley north of Linden Street; thence in an easterly direction <br />along the north right -of -way of said alley to the west right -of -way line of Wilber <br />Street; thence in a northerly direction along the west right -of -way line of Wilber <br />Street to the west extension of the north property line of 319 Birdsell Street; thence <br />in an easterly direction along the north property of 319 Birdsell Street to the east <br />right -of -way line of Birdsell Street; thence in a southerly direction along the east <br />right -of -way line of Birdsell Street to the north right -of -way line of the first alley <br />north of Linden Street; thence in an easterly direction along the north right -of -way <br />of said alley to the east right -of -way line of Walnut Street; thence in a southerly <br />direction along the east right -of -way line of Walnut Street to the south right -of -way <br />line of Liston Street; thence in a westerly direction along the south right -of -way <br />line of Liston Street to the west right -of -way line of Studebaker Street; thence in a <br />northerly direction along the west right -of -way line of Studebaker Street to the south <br />right -of -way line of Colfax Street; thence in a westerly direction along the south <br />right -of -way line of Colfax Street to the west right -of -way line of Birdsell Street; <br />thence in a northerly direction along the west right -of -way line of Birdsell Street <br />to the south property line of 135 Birdsell Street; thence in a westerly direction <br />along the south property line of 135 Birdsell Street to the south right -of -way line <br />of Colfax Street which continues in a straight line westerly from the south property <br />line of 135 Birdsell Street, to the west right -of -way line of Adams Street, thence in <br />a northerly direction along the west right -of -way line of Adams Street to the south <br />right -of -way line of Orange Street, thence in a westerly direction along the south <br />right -of -way line of Orange Street to the east right -of -way of College Street; thence <br />in a southerly direction along the east right -of -way of College Street to the south <br />right -of -way line of Washington Street; thence in a westerly direction along the south <br />right -of -way line of Washington Street to theeast right -of -way line of Grant Street; <br />thence in a southerly direction along the east right - off --way line of Grant Street to <br />the north right -of -way line of the Penn Central Railroad; thence in a north - westerly <br />direction along the north right -of -way line of Penn Central Railroad to the west <br />right -of -way line of Olive Street; thence in a northerly direction along the west <br />right -of -way line of Olive Street to the north right -of -way of the first alley north <br />of Kenwood Street, which is the point of beginning. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: <br />1. That the proposed Urban Renewal Area described above is a slum, blighted, deter- <br />iorated, or deteriorating area appropriate for an urban renewal project and that the undertak- <br />inq by the City of South Bend, Department of Redevelopment surveys and plans for an urban re- <br />newal project of the character contemplated by Section 110 (c) of Title I in the proposed Ur- <br />ban Renewal Area is hereby approved. <br />2. That the financial assistance available under Title I is needed to enable the <br />City of South Bend, Department of Redevelopment to finance the planning and undertaking of <br />the proposed Project. <br />3. That it is cognizant of the conditions that are imposed in the undertaking and <br />carrying out of urban renewal projects with Federal Financial assistance under Title I, in- <br />cluding those relating to (a) the relocation of site occupants, (b) the provision of local <br />grants -in -aid, (c) the prohibition of discrimination because of race, color, creed, or national <br />origin, and (d) the requirement that the locality present to the Secretary of Housing and Ur- <br />ban Development, as a prerequisite to approval of the application described below, a workable <br />program for community improvement, as set forth in Section 101 (c) of Title I, for utilizing <br />appropriate public and private resources to eliminate and prevent the development or spread <br />of slums and urban blight. <br />
