REGULAR MEETING <br />PETTTTON <br />Petition to Amend Zoning Ordinance <br />MARCH 8, 1971 <br />We, the undersigned, do hereby respectfully make application and petition the City of South Bend <br />Indiana, Common Council to amend the Zoning Ordinance of the City of South Bend as hereinafter <br />requested, and in support of this application, the following facts are asserted: <br />1. The property sought to be rezoned is bounded on the East by Ironwood, on the <br />South by the recorded Plat of Scottsdale Addition, Section "F" and proposed <br />Scottsdale Addition, ,Seetlenr"F and Section <br />"G ", on the West by the recorded Plats of Scottsdale Addition, Sections "D" <br />and "E ", and on the North by lands owned by the South Bend City Water Works <br />and Eugene F. and Delores J. Edwards; <br />2. The property sought to be rezoned is owned by Place and Company, Inc., an <br />Indiana Corporation; <br />3. The legal description of the property sought to be rezoned is as follows: <br />A part of the Southeast Quarter of the Southeast Quarter and a part of the <br />Southwest Quarter of the Southeast Quarter of Section 30, Township 37 North, <br />Range 3 East, Centre Township, St. Joseph County, City of South Bend, Indiana, <br />described as follows, viz: Beginning (354.93) feet North of the Southeast <br />corner of the Southeast Quarter of the Southeast Quarter of said Section 30; <br />thence North (929.4) feet to the Northeast corner of said Southeast Quarter of <br />the Southeast Quarter; thence West (1319.38) feet to the Northwest corner of <br />the said Southeast Quarter of the Southeast Quarter; thence South 45 degrees <br />30 minutes West (180.75) feet; thence South 6 degrees 53 minutes West (230) <br />feet; thence South 6 degrees 53 minutes West (100) feet; thence South 7 degrees <br />09 minutes East (61.85) feet; thence South 6 degrees 53 minutes West (120) <br />feet; thence South 83 degrees 07 minutes East (85) feet; thence South 8 degrees <br />03 minutes West (70.3) feet; thence South 89 degrees 44 minutes East (110) feet; <br />thence South 83 degrees 52 minutes East (195.46) feet; thence South 89 degrees <br />44 minutes East (300) feet; thence North 74 degrees 51 minutes East (131.64) <br />feet; thence South 61 degrees 21 minutes East (119.92) feet; thence South 17 <br />degrees 15 minutes 30 seconds East (112.93) feet; thence South 0 degrees <br />16 minutes West (120) feet; thence South 89 degrees 44 minutes East (128.27) <br />feet; thence North 71 degrees 42 minutes 40 seconds East (61.99) feet; thence <br />North 87 degrees 55 minutes 30 seconds East (118.26) feet; thence South 89 <br />degrees 44 minutes East (220.45) feet to the place of beginning containing <br />26.6 acres more or less; <br />4. It is respectfully requested that the foregoing described property be rezoned <br />from "A" Residence District use to "A -2" Planned Residential Development <br />District use; <br />5. It is proposed that the property will be put to the uses permitted by such <br />"A -2" Planned Residential Development District and particularly without limit- <br />ing the foregoing and, among other things, will be put to Planned Unit Resi- <br />dential Development use, consisting of from 160 to 190 residential condominiums <br />of heights of no.more than two (2) stories, with some of heights of only one <br />(1) story; <br />6. Off - street parking spaces will not provided in number as required by law. <br />7. There is attached hereto a plot plan showing the involved property, as well as <br />other surrounding properties, and a memorandum disclosing the names and <br />addresses of all the individuals, firms or corporations owning property within <br />Three Hundred (300) feet of the property sought to be rezoned; no site develop- <br />ment plan accompanies this petition because, pursuant to Section 23 of the City <br />of South Bend Zoning Ordinance, same is not required inasmuch as the petitioner <br />is praying a rezoning to "A -2" Planned Residential Development District. <br />Dated this 27th day of February, 1971. <br />PLACE AND COMPANY, INC. <br />By /s/ Andrew S.
