TOW <br />REGULAR MEETING MARCH 8, 1971 <br />PETITIONS <br />Petition to Amend Zoning Ordinance <br />'BEFORE THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA <br />IIN THE MATTER OF SOUTH BEND RANGE CORPORATION, Petitioner <br />Your Petitioner hereby respectfully makes application and petitions the Common Council of the <br />City of South Bend, Indiana to amend the zoning ordinance of the City of South Bend, Indiana <br />as hereinafter requested and, in support of this application, the following facts are shown: <br />1. The property sought to be rezoned is located and occupies entirely the area <br />bounded as follows: On the west by the west line of now vacated Cherry Street; <br />on the north by the south line of the alley which runs east from Cherry Street <br />to Chestnut Street between Jefferson Street and Napier Street; on the east by <br />the west line of an alley which runs south from Jefferson Street to Napier Street <br />between Cherry Street and Chestnut Street and the extention of that westerly <br />line of that alley southward to the South line of Napier Street; and on the <br />south by the south line of Napier Street, all in the City of South Bend, Indiana. <br />2. All of the above described property is owned by your petitioner. <br />3. A legal description of the 'property described in paragraph one hereof is as <br />follows: Beginning at a point on the westerly line of now vacated Cherry Street <br />which is directly west of the northwest corner of Lot Numbered 29 as shown on <br />the recorded Plat of John F. Kirby's Subdivision of a part of Bank Out Lot Num- <br />bered 29 as shown on the recorded Plat of John F. Kirby's Subdivision of a part <br />of Bank Out Lot Numbered 83 of the Second Plat of Out Lots of the Town, now City <br />of South Bend, Indiana, platted by the State Bank of Indiana; thence southerly <br />along the west line of now vacated Cherry Street to a point directly west of the <br />northwest corner of Lot Numbered 37 in said Dubdivision; thence East along the <br />north line of said Lot Numbered 37 to the northeast corner of said lot; thence <br />north a distance of 66 feet to the southeast corner of Lot Numbered 32 in said <br />Subdivision; thence north along the east lines of Lots Numbered 32, 31, and 29 <br />of said Subdivision to the northeast corner of Lot Numbered 29 in said Subdivi- <br />sion; thence west along the north line of said Lot Numbered 29 to the northwest <br />corner thereof; thence west to the place of beginning, all in the City of South <br />Bend, Indiana. <br />4. It is desired and requested that the foregoing property be rezoned: <br />From "A" Residential, "A" Height and Area District <br />To "E" Heavy Industrial "F" Height and Area District. <br />5. It is proposed that a building will be constructed upon said property in <br />accordance with specifications submitted in connection herewith which will be <br />used for carrying out your Petitioners manufacturing processes as is presently <br />being done in its building to the west and to the south of the subject premises. <br />6. Attached is a copy of (a) a plot plan showing your Petitioners property <br />specified herein and other neighboring properties which may be affected; (b) the <br />names and addresses of the record owners of all property within three hundred <br />(300) feet of the subject real estate which may be affected by this rezoning; <br />and (c) a site development plan. <br />IWHEREFORE, your Petitioner respectfully requests the amendment to the Zoning Ordinance of the <br />City of South Bend, Indiana as requested herein. <br />/s/ Bruce H.
